AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE ACCEPTANCE OF A GRANT FROM THE
TRANSPORTATION IMPROVEMENT BOARD FOR THE RECONSTRUCTION OF '~A"
STREET SW, 3RD TO MAIN.
WHEREAS, the City Council of the City of Auburn must
adopt and approve all appropriations by Ordinance pursuant to
Chapter 35A.33 RCW; and
NOW, THEREFORE, THE CITY COUNCIL OF
WASHINGTON, DO ORDAIN AS FOLLOWS:

Main, in the amount of $761,000 with $190,000 local matchin9
funds from the 102 Gas Tax Fund and authorizes the Mayor to
execute an Urban Design Prospectus between the City and the
Transportation Improvement Board, a copy of which is attached
hereto as Exhibit "A" and is incorporated herein by reference.

~ The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
~ This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication, as provided by law.

Description of Proposed Improvements

· Attach a sketch of the proposed roadway section (8.5" x 11 '), tight of way to dght of way, conforming to applicable design
standards.
· Attach a copy, or portion of, the current agency-approved SLx Year Transportation Improvement Program and/or Transportation
Plan. This project must be included in the approved Transportation Improvement Program and/or approved Transportation Plan.

The project will reconstruct the streets in this vicinity, providing adequate structural section and enlarging curb
radii to accommodate transit buses. The project will provide full-width sidewalks to ADA standards, along with
curb, gutter, and City Master Planned utility upgrades necessary to improve this vicinity of the City's central
business district. Input from transit agencies is required and completion of 3rd Street SW grade crossing street
pre-design report.

IN CONSIDERATION of the allocation by the Transportation Improvement Board of Urban Arterial Trust Account (UATA) funds to the proiect
and in the amount set out above, the agency hereby agrees that as condition precedent to payment of any UATA funds allocated at any time
to the above referenced project; it accepts and will comply with the terms of this agreement, including the terms and conditions set forth in
RCW 47,26; the applicable ruJes and regulations of the Transportation Improvement Board, and all representations made to the
Transportation improvement Board upon which the fund allocation was based; all of which are familiar to and within the knowledge of the
agency and incorporated herein and made a part of this agreement, although not attached. The officer of the agency(les), by the signature(s)
below, hereby certifies on behalf of the agency that local matching funds and ether funds represented te be committed to the project will be
available as necessary to implement the projected developmect of the project as set forth in the DESIGN proposal prospectus, acknowledges
that funds hereby authorized are for the development of the construction proposal as defined by Chapter 126, Laws of 1973, 1st Ex. Sess.,
and is subject to immediate cancellation by the Transportation improvement Board if the project's development is delayed in relation to the
schedule presented to, and accepted by, the Board at the time of project authorization.
Projects in cieen air non-attainmeet areas are subject to air quality conformity requirements as specified in RCW 70.94. The lead agency
certifies that the project meets all applicable Clean Air Act requirements.
IN CONSIDERATION of the promises and performance of the stated conditions by the agency, the Transportation improvement Board hereby
agrees to pay the agency from UATA funds allocated, and not otherwise, for its eligible costs during the ensuing quarter year not to exceed
the amount specified. Such obligation to pay UATA funds extends only to project cost incurred after the date of the Board's alfucation funds
and authodzatlon to proceed with the project except as provided by the Board rules on projects that require a value engineering study pdor to
approval of the design proposal prospectus.
