WHEREAS, PROPERTY, an approximately the City of Auburn; and the City of Auburn has acquired 'the FENSTER approximate 9-acre parcel of property located on the east side of the City and contiguous to WHEREAS, the property purchased is to be used for municipal park purposes and therefore is for a municipal purpose; and WHEREAS, in accordance with RCW 35A.14.300 the City Council may by majority vote annex such property for a municipal purpose when owned by the City; and the subject property was acquired by the City on WHEREAS, February 14, 1996; and WHEREAS, the City Council on May 5, vote, instructed the Planning Department to of 1997 by majority forward the Notice Intention to the King County Boundary Review Board; and Ordinance No. 4998 July 22, 1997 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, notice of intention to annex was King County Boundary Review Board; and WHEREAS, no request annexation law; and WHEREAS, at the held July 21, 1997, passed and approved; filed with the the King County Boundary Review Board received to invoke its jurisdiction, therefore the is deemed approved on July 7, 1997 as a matter of regularly scheduled City Council meeting Auburn City Ordinance No. 4994 was duly and NO. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ~ Auburn City Ordinance No. 4994 passed July 21, 1997, is herewith repealed in its entirety. ~ That there shall be annexed to the City of Auburn, Washington, the property situated in the County of King, State of Washington, which legal description is described in Exhibit "A" attached hereto and incorporated by reference as if set out in full. Washinaton. described as foIIows: Beginning on a point on the Auburn City Limits as established by City of Auburn Ordinance # 4605, said point lying on the south right of way line of 4th St. SE and its intersection with the west bank of the Green River; thence southeasterly along the west bank of the Green River to the east line of the west one-half of section 17, township 21 north, range 5 E.W.M.; thence south along said east line to Auburn City Limits as established by City of Auburn Ordinance # 3509; thence west along said city limits, also the north line of the Northern Pacific's Railroad right of way, to the east line of the Valley Meadows Addition subdivision, according to the plat thereof recorded in volume 161 of plats, page 59, in King County, Washington; thence north along said east line, also the city limits as established by ordinance # 3509, to the City Limits as established by ordinance # 4605; thence east along said city limits to the point of beginning.
