AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
4 WASHINGTON, AMENDING ORDINANCE NO. 4766, WHICH AMENDED
ORDINANCE 4627 BY REVISING CONDITION NO. 8.E TO REQUIRE THAT A
5 PARK AND RIDE LOT BE PROVIDED CONCURRENTLY WITH THE OPENING OF
PHASE II OF THE SUPERMALL AND A COVERED WALKWAY BE
6 CONSTRUCTED, THIS ORDINANCE NO. 5003 NOW REVISING CONDITION
8.E AS AMENDED IN ORDINANCE NO. 4766 TO REMOVE THE REQUIREMENT
7 OF CONSTRUCTING A COVERED WALKWAY.

WHEREAS, Ordinance No. 4766 approved by the City Council
9
of the City of Auburn on July 17, 1995 amending Ordinance No.
10
1! 4627, which was approved by the City Council on April 28,
12 1993, by revising Condition No. 8.E to require that a Park and
Ride Lot be provided concurrently with the opening of Phase II
14
of the Supermall and to require the construction of a covered
16 walkway; and
17 WHEREAS, the Supermall has requested that Condition No.
18 8.E of Ordinance No. 4766 be revised to remove the requirement
19
to construct a covered walkway; and
20
WHEREAS, Condition No. 20 of Ordinance No. 4627 allows
21
amendments to be made to said Ordinance; and
22
23 WHEREAS, the proposed amendment to Ordinance No. 4766 is
24 considered a minor change and has therefore been reviewed by
25
Ordinance NO. 5003

Council and approved by the City Council;

4 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
5 WASHINGTON, DOES ORDAIN AS FOLLOWS:
6 ~ City of Auburn Ordinance No. 4766 approved by
7
the City Council on July 17, 1995, is hereby amended to revise
8
Condition No. 8.E. A copy of said revised Condition No. 8.E
9
is attached hereto as Exhibit "A" and is incorporated herein
]] by this reference.
12 ~ All remaining sections and amendments to
13 Ordinance No 4627 and Ordinance 4766 shall remain in full
·
force and effect.

~_~ Upon passage, approval and publication of

17 this Ordinance as provided by law, the City Clerk of the City
18 of Auburn shall cause this Ordinance to be recorded in the
19
Office of the King County Auditor, Division of Records and

Elections.

23 such administrative procedures as may be necessary to carry
24 out the directives of this legislation.

4 publication as provided by law, and upon the payment of
5 obligation currently due and payable to the Auburn Downtown

1. Subject to METRO's and/or Pierce Transit's willingness to
5
accept and operate it, offer a 500-stall weekday park and
ride lot on site consisting of 500 of the general parking
7
stalls for the project. The park and ride lot shall be
8
provided concurrently with the opening of Phase II of the
9
SuperMall or earlier upon request by METRO and/or Pierce
10
Transit if that agency believes it to be warranted.
