S 0 i 9 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON PROPERTY LOCATED AT 2610 HEMLOCK STREET SE, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM RR (RURAL RESIDENTIAL) TO R-3 (DUPLEX). WHEREAS, Application No. to the Council of the City of Auburn, BRECKENRIDGE, requesting the rezoning REZ0001-97 has been submitted Washington, by FRARY of the real property hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on August 19, 1997, at the conclusion of which the Hearing Examiner Ordinance No. 5019 September 5, 1997 Page 1 recommended the approval and WHEREAS, the City of the rezoning of said Council, on September considered said request and affirmed the recommendation for rezone based upon the of Fact and Conclusions, to-wit: property; 2, 1997, Hearing Examiner's following Findings FINDINGS OF FACT The applicant, Frary Breckenridge, has requested that her property which is located at 2610 Hemlock Street SE be rezoned from its existing RR, Rural Residential zoning, to the R-3 Duplex zoning. The purpose of the rezone is to allow her to rebuild her single family home that was recently damaged by fire. While the existing RR zoning does allow for single family homes, the setbacks are such that it would leave the applicant with fewer opportunities to rebuild. For example, the front and rear yard setbacks are each 35 feet and the interior side yard setback is 10 feet. The R-3 zone will allow for a 20 foot front yard setback, a 25 foot rear yard setback and a 5 foot side yard setback. 3 ° The property is approximately 28,750 square feet in size. Its dimensions are approximately 149.9 by 192.75 feet. The property contains some steeper slopes which also limit the ability to place a new house on the property. The Comprehensive Plan map designates this property and adjoining properties as Moderate Density Residential. CONCLUSIONS OF LAW The rezone should be approved. It is consistent with the Comprehensive Plan Map designation, zoning and existing uses in the area. The rezone should be approved as a conditional rezone to allow the reconstruction of the single family home. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone from RR (Rural Residential) to R-3 (Duplex) is hereby approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Ordinance No. 5019 September 5, 1997 Page 3 Section 2. The following described property located on .66 acres of property located at 2610 Hemlock Street SE, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from RR (Rural R 3 (Duplex) and legally described on Residential) to attached Exhibit Section 3. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of and Elections. such out the King County Auditor, Division of Records Section 4. The Mayor is hereby authorized to implement administrative procedures as may be necessary to carry the directions of this legislation. Section 5.
