AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE CITY TO SELL AND TRANSFER FEE

OWNERSHIP OF REAL PROPERTY KNOWN AS THE GOEDECKE NORTH
5 PROPERTY, OBTAINED BY THE SEWER DIVISION OF THE PUBLIC WORKS
DEPARTMENT, THROUGH FORECLOSURE OF LOCAL IMPROVEMENT
ASSESSMENT LIENS, TO OPUS NORTHWEST, L.L.C.

8 WHEREAS, the City Sewer Division of the Public Works
9 Department obtained the property known as the "Goedecke North"
10
property through foreclosure of local improvement assessment
liens described in the Local Improvement Assessment Deed dated
May 23, 1994, recorded under King County recording number
14 9405260718; and
15 WHEREAS, the City Sewer Division of the Public Works
Department is responsible for recovering its ratepayer's money
17
spent by the City Sewer Division of the Public Works
19 Department on the sanitary sewer local improvements
20 constructed on the "Goedecke North" property; and
WHEREAS, State statute (RCW 35.53.030) authorizes a city
22
to sell properties acquired through foreclosure of local
improvement assessment liens for such price and upon such
24
25 terms as may be determined by resolution of the council; and

Wq{EREAS, the City Sewer Division of the Public Works
Department has negotiated a fair purchase price in the

4 Purchase and Sale Agreement, a copy of which is attached
5 hereto as Exhibit "A" and is incorporated by this reference;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, DO ORDAIN AS FOLLOWS:

~ The Mayor of the City of Auburn is hereby
9
10 authorized to enter into a Purchase and Sale Agreement between
1! the City of Auburn and OPUS NORTR~EST, L.L.C., to sell, convey
12 and transfer fee ownership of the "Goedecke North" property.
A copy of said Agreement substantially in final form with
]4
final property lines to be determined and agreed to by the
15
City and OPUS NORTHWEST at time of sale, is attached hereto as
Exhibit "A" and incorporated herein by this reference.

~ The Mayor is hereby authorized to implement
19
such administrative procedures as may be necessary to carry
20
out the directions of this legislation.

22 ~ This Ordinance shall take effect and be in
23 force five (5) days from and after its passage, approval and
24
publication, as provided by law.
