WHEREAS, Application No. REZ0003-97 has been submitted to the Council of the City of Auburn, Washington, by RALPH and TINA WADDLE, requesting the rezoning of the real property hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on November 18, 1997, at the conclusion of which the Hearing Examiner 'Ordinance No. 5058 December 4, 1997 Page 1 recommended the approval of the rezoning of said property; and WHEREAS, the City Council, on considered said request and affirmed the recommendation for rezone based upon the of Fact and Conclusions, to-wit: December 1, 1997 Hearing Examiner's following Findings FINDINGS OF FACT The applicants, Ralph and Tina Waddle, have requested their property be rezoned from the existing zoning designation of RR, Rural Residential, to an R-2, Single Family, zone. The property is 3.94 acres in size and is located at 36229 148th Avenue SE. The property contains a single family home with the remainder being vacant. The applicants have only submitted an application to have their property zoned in accordance with the Comprehensive Plan and have not submitted any applications for any future development. The existing Comprehensive Plan map designation is Single Family Residential which the R-2 zone is appropriate for. The subject rezone is immediately adjacent to Janssen's Addition. This is a 140 lot single family subdivision that lies on the north boundary of the subject Ordinance NO. 5058 December 4, 1997 Page 2 o property. Janssen's Addition is zoned R-2 and is served by all necessary public infrastructure including streets and utilities. The subject property is served by a private water and sewer system. The property also abuts 148th Avenue which is a two lane rural street with open ditches on both sides. The property also contains wetlands as identified by the City's wetland inventory. While the properly abuts a developed parcel (Janssen's Addition) that is served by adequate public infrastructure, excepting the storm drainage system, the future development of the subject parcel will be problematic. The subject parcel will need to either update a booster pump station for water, provide an additional pump or replace the existing pumps, in order to get sufficient water flow to serve the property. While sanitary sewer is available in the vicinity, the topography of the site may cause concerns with flow. The property also abuts a substandard street which will need to be improved for any subsequent development as well as address the wetland issues on the site. The appropriate environmental review was done on the rezone only. This is considered to be a non-project action and the environmental review was done on the rezone aspect only. When a specific development is proposed, there will need to be additional environmental review performed that completely analyzes all issues of the site. This will include at a minimum, a traffic analysis, an utility analysis, a wetland delineation and mitigation plan, together with other issues that may involve the parcel. Ordinance No. 5058 December 4, 1997 Page 3 At the time of the public hearing, adjoining neighbors in Janssen's Addition subdivision expressed concern about wetlands and drainage issues. Their concerns will be addressed when an ultimate development plan is submitted for the property. The contents of the case file, REZ0003-97, and the environmental file, SEP0041-97, of this project are hereby incorporated by reference and made part of the record of the hearing. CONCLUSIONS OF LAW The rezone may be approved· It is consistent with the Comprehensive Plan map designation. The rezone, in and of itself, does not allow a subsequent use of the property without additional environmental review. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone from RR (Rural Residential) to R-2 (Single Family) is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance No. 5058 December 4, 1997 Page 4 ~. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. ~ The following described property located at 36229 148th Avenue SE, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from RR (Rural Residential) to R-2 (Single Family) and legally described as follows: STR 272105 TAX LOT #2-76, RECORDING NO. 164 LOT 1 OF KC SP 7603120573. ~9_C~. The above rezone is hereby approved subject to the following condition: 1.
