WHEREAS, Application No. CUP0006-97 dated October 13, 1997, together with site plans therefore, has been submitted to the City of Auburn, Washington, by ST. MATTHEW EPISCOPAL CHURCH, requesting a Conditional Use Permit to allow for a 5,500 square foot property zoned R-2 Northeast, within expansion of the existing church on (Single Family) located at 123 "L" Street the City of Auburn, Washington, hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and Ordinance No. 5079 March 6, 1998 Page 1 WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on February 18, 1998, at the conclusion of which the Hearing Examiner recommended the approval of the issuance of a Conditional Use Permit to allow for a 5,500 square foot expansion of the existing church on property zoned R-2 (Single Family) located at 123 "L" Street Northeast, within the City of Auburn, Washington; and WHEREAS, the City Council, on March 2, 1998, considered said request and affirmed the Hearing Examiner's decision for the issuance of a Conditional Use Permit to allow for a 5,500 square foot expansion of the existing church on property zoned R-2 (Single Family) located at 123 "L" Street Northeast, within the City of Auburn, based upon the following Findings of Fact and Conclusions, to-wit: FINDINGS OF FACT 1. The applicant, St. Matthew Episcopal Church, has requested a conditional use permit that would allow a 5,500 square foot addition onto their existing ,church. The existing church is 9,200 square feet and is located at 123 "L" Street NE. The proposed addition will contain a 285-seat sanctuary and its height will be a Ordinance No. 5079 March 6, 1998 Page 2 maximum of 30 feet, which is the maximum height allowed by the existing zoning on the property. The property is zoned R-2, Single Family. The R-2 zone at Section 18.14.030(J) of the Zoning Ordinance allows for churches if a conditional use permit is issued[. The proposed addition will be located at the south end of the existing church building and will displace most of the parking that is currently used by the church. The existing parking lot is currently not developed pursuant to City standards, e.g., pavin~ and landscaping. The site plan submitted with the application illustrates 70 parking spaces. Twenty-nine of the spaces will be located adjacent to the new addition and the remaining 41 will be on the north side o~ the existing church. The site plan illustrates that all of the parking will be paved and there is enough area to meet the requirements of the Zoning Code with regard to landscaping. The amount of parking required for churches is based upon the seating area of the sanctuary. The 285-seat sanctuary of the proposed building requires 57 parking spaces pursuant to the Zoning Code. The applicant has indicated that the existing church facility will be used for such things as church meetings, choir rehearsal, classrooms, daycare, offices, etc. There are no proposed uses that would be used simultaneous and be in conflict with the sanctuary use in the proposed addition. The proposal will also have to provide for storm water detention on site. The site plan as sulbmitted illustrates that at the north and south ends of the property there are proposed to be infiltration trenches for the storm water as will as biofiltration swales for water quality. 5 o Since the property is zoned R-2, a lot coverage of 35% is the maximum allowed. The site plan illustrates that there will be 22% lot coverage. 6. The proposed addition will abut a street on the south and east sides. On the west are single family homes. Ordinance No. 5079 March 6, 1998 Page 3 7 o The parking lot on the north side of the existing church will be adjacent to a residential area on the west and north sides and will abut a street on the east side. The exterior facade of the building is proposed! to be constructed of materials consisting of cedar siding, with a possible stone base, and it will ihave a composition roof. CONCLUSIONS OF LAW There are a series of criteria which must be established prior to the time a conditional use permit may be granted. These criteria are as set forth in Section 18.64.040 of the Zoning Ordinance. The use will have no more adverse effect on the health, safety or comfort of persons living or working in the area, and will be no more injurious, economically or otherwise, to property or improvements in the surrounding area, than would any use generally permitted in the district. Since a church has been generally established on the property for a number of years its use has been acceptable to the neighborhood. The addition of the sanctuary is not intended to appreciatively expand the church but to provide a specific sanctuary area as opposed to using other areas of the church for its sanctuary. It is not anticipated the general membership of the church will grow significantly because of the expansion. The construction material of the exterior facade together with the landscaping will help ensure the church will not have an adverse effect on the neighborhood. 3. The proposal is in accordance with the goals, and objectives of the Comprehensive Plan. Ordinance No. 5079 March 6, 1998 Page 4 policies The proposal is located within a single-family designation as illustrated on the Comprehensive Plan map. On page 14-3 of the Comprehensive Plan, it states that churches are a compatible use in the single-family designations. The proposal complies with all requirements of the Zoning Ordinance. The site plan illustrates that the proposal either complies with or is capable of complying with all requirements of the Zoning Code. The proposal can be constructed and maintained so as to be harmonious and appropriate in design, character, and appearance with the existing or intended character of the general vicinity. Since an existing church is currently on the property the character of the area has been established and the materials used for the exterior construction ~ill be similar to a residential neighborhood thereby ensuring the proposal will be appropriate for the area. 6. The proposal will not adversely affect the public infrastructure. There is no indication that the other public infrastructure will be impacted. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this Conditional Use Permit to allow for a 5,500 square foot expansion of the existing church, on property Ordinance No. 5079 March 6, 1998 Page 5 zoned R-2 (Single Family) located at 123 "L" Street within the City of Auburn, Washington, is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Ordinance. Section 2. to allow for a Conclusions, are herewith incorporated in this church on property zoned R-2 (Single Family), located at "L" Street Northeast, within the City of Auburn, County King, State of Washington, legally described as follows: A Conditional Use Permit is hereby approved 5,500 square foot expansion of the existing 123 of LOTS 1-4, BLK 2, THOMAS G. SUTHERLAND 1sT ADDN AND LOT 1 & 4-8, BLK 3, DAVID BOTTING 2~ ADDN TO THE CITY OF AUBURN, KING COUNTY, WASHINGTON. Section 3. Ail perimeter landscaping shall be a Type II as defined by Section 18.50.040(B) of the Zonin(j Code. Any parking or driveways adjacent to the residentially zoned property shall be a minimum of 10 feet in width and s[hall be a Type I landscaping as defined by Section 18.50.040(A) of the Zoning Code.
