AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO ACCEPT THE
DONATION OF ELEVEN HOME FIRE ESCAPE LADDERS FROM EAGLE
HARDWARE AND GARDEN TO BE USED BY THE CITY OF AUBURN OR THE
AUBURN FIRE DEPARTMENT FOR THE PUBLIC PURPOSES OF FIRE
PREVENTION AND PUBLIC EDUCATION.
WHEREAS, the City Council of the City of Auburn desires
to accept the donation by EAGLE HARDWARE AND GARDEN of eleven
(11) home fire escape ladders valued at $28.95 each for use by
the Auburn Fire Department for the public purposes of fire
prevention and public education; and
WHEREAS, the City of Auburn has determined that such
donation is for a public purpose and in the best interest of
the City;
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. PURPOSE. The purpose of this Ordinance is to
accept the donation by EAGLE HARDWARE AND GARDEN for eleven
(11) home escape ladders valued at $28.95 each, for use by the
City of Auburn or the Auburn Fire Department for the public
purposes of fire prevention and public education. A
description of said ladders is attached hereto as Exhibit "1'
and made a part hereof as though set forth in full.

Section 2. ACCEPTANCE AND A~REEMENT. The City hereby
approves the Acceptance and Agreement of the donations
itemized in Section 1 above and determines that such
acceptance is in the public interest and for the public
purposes set forth in Section 1 above. A copy of said
Acceptance and Agreement is attached hereto as Exhibit

Department is accepted on behalf of the CITY OF AUBURN by
CHARLES A. BOOTH, Mayor, as authorized by RCW 35A.11.040.
The Auburn City Council has determined and declares that
acceptance of the donation is for a public purpose and in the
best interest of the CITY.
AGREEMENT
THE ABOVE ACCEPTANCE AND THIS AGREEMENT is made and
entered into this /~day of ~ , 1998, by and
between the CITY OF AUBURN, a ~unicipal corporation o~ the
State of Washington, whose address is 25 West Main, Auburn,
Washington 98001, hereinafter referred to as "CITY" and EAGLE
HARDWARE AND GARDEN, hereinafter referred to as "EAGLE".
IN CONSIDERATION OF THE COVENANTS AND CONDITIONS
CONTAINED HEREIN, THE PARTIES AGREE AS FOLLOWS:
1. PURPOSE:
The purpose of this Agreement is the acceptance by
