HomeMy WebLinkAbout5109ORDINANCE NO. 5 1 0 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, TO AUTHORIZE THE TRANSFER OF FUNDS FROM THE WASHINGTON TRAFFIC SAFETY COMMISSION THROUGH PERFORMANCE BASED GRANTS TO THE CITY OF AUBURN FOR THE PURCHASE OF RADAR EQUIPMENT FOR SCHOOL ZONE ENFORCEMENT. WHEREAS, our children is of paramount community; and WHEREAS, enforcement of the City of Auburn recognizes that the safety of importance to the quality of our the speeding laws significantly impacts the safety of our community; and WHEREAS, the use of radar-measuring devices assists greatly in the enforcement of the speeding laws; and WHEREAS, Senate House Bill 2518 amended RCW 46.61.400 to double the fines of speeding in a school or playground area; and WHEREAS, half the moneys collected under this program will fund enforcement tools; and WHEREAS, for every forty (40) infractions written under RCW 46.61.400 in a school zone, the Washington Traffic Safety Commission will provide a radar unit from the grant for further enforcement action. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance No. 5109 June 30, 1998 Page 1 Sectlon 1. PURPOSE. The purpose of this Ordinance is as follows: To authorize the transfer of funds from the Washington Traffic Safety Commission through performance based grants for the purpose of purchasing radar equipment for school zone Constitutionality or Invalidity. If any sentence, clause or phrase of this any reason held to be invalid or enforcement. Section 2. section, subsection, Ordinance is for unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation.
