ORDINANCE NO. 5 116
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE VACATION OF FIVE (5) FEET OF
STREET RIGHT-OF-WAY ALONG THE WEST SIDE OF "J" STREET SE
(MAIN TO 2~ STREET SE), WITHIN THE CITY OF AUBURN,
WASHINGTON.
WHEREAS, Petition No. V-02-97 has been filed by the
owners of two-thirds or more of the property abutting the
portion of right of way requested to be vacated; and
WHEREAS, the statute requires that the City Council
schedule a public hearing when a valid petition is filed
with the City; and
WHEREAS, the public hearing was held on July 20, 1998
before the City Council;
NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. That five (5) feet of street right-of-way
along the west side of "J" Street SE (Main to 2~ Street
SE), is legally described on attached Exhibit "A" and
incorporated by reference herein, be and the same is hereby
vacated, and the property lying in said portion of a certain
street right of way described hereinabove, shall be returned
and belong to those persons entitled to receive the property
in accordance with the law.
Section 2. The City shall retain a utility easement
for the construction, repair and maintenance of all public
utilities over, across, upon and underneath that portion of
the property described in Section 1 of this Ordinance.
Section 3. Upon the passage, approval and publication
of this Ordinance, the City Clerk for the City of Auburn
shall cause this Ordinance to be recorded in the office of
the King County Auditor.
Section 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directires of this legislation.

Section 5. This Ordinance shall take effect and be in
force five days from and after its passage, approval, and
publication as provided by law.
