ORDINANCE NO. 5 I 4 8
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE VACATION OF A PORTION OF RIGHT-OF-
WAY NEAR 8TH STREET NE IN THE VICINITY OF PIONEER CEMETERY,
WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Petition No. V-02-98 has been filed by the
owners of two-thirds or more of the property abutting the
portion of right of way requested tO be vacated; and
WHEREAS, the statute requires that the City Council
schedule a public hearing when a valid petition is filed
with the City; and
WHEREAS, the public hearing was held on September 21,
1998 before the City Council;
NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. That a portion of right of way near 8th
Street NE in the vicinity of Pioneer Cemetery, is legally
described on attached Exhibit "A" and incorporated by
reference herein, be and the same is hereby vacated, and the
property lying in said portion of a certain street right of
way described hereinabove, shall be returned and belong to
those persons entitled to receive the property in accordance
with the law.
Section 2. The City shall retain a utility easement
for the construction, repair and maintenance of all public
utilities over, across, upon and underneath that portion of
the property described in Section 1 of this Ordinance.
Section 3. Upon the passage, approval and publication
of this Ordinance, the City Clerk for the City of Auburn
shall cause this Ordinance to be recorded in the office of
the King County Auditor.

Section 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directires of this legislation.
Section 5. This Ordinance shall take effect and be in
force five days from and after its passage, approval, and
publication as provided by law.

Beginning at the point of intersection of the North line of
said Section 18, with the Easterly line of State Road No. 5,
which point is 1091.20 feet East of the Northwest corner of
said Section 18; Thence continuing East, along said Section
line, 160.00 feet to the TRUE POINT OF BEGINNING OF THE
TRACT HEREIN DESCRIBED:
Thence East, along said Section line, 177.99 feet to a point
which is 1429.19 feet East of the Northwest Corner of said
Section 18; Thence South 359.25 feet more or less, to a
point on a line which is parallel to and 300.00 feet North
of the previous North City Limits of the City of Auburn;
Thence West along said parallel line 253 77 feet; Thence
