Assessor's Property Tax Parcel/Account Number: 215400-0125 [] Assessor Tax # not yet assigned ORDINANCE NO. 5 14 9 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 330 "V" STREET SE, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-1 (SINGLE FAMILY) TO R-2 (SINGLE FAMILY). WHEREAS, Application No. REZ0002-98 has been submitted to the Council of the City of Auburn, Washington, by HILDA WARD, requesting the rezoning of the real property hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on August 18, 1998, at the conclusion of which the Hearing Examiner Ordinance No. 5149 September 9, 1998 Page 1 recommended the approval of the rezoning of said property; and WHEREAS, the City Council, on September 8, 1998 considered said request and affirmed the Hearing Examiner's recommendation for rezone based upon the following Findings of Fact and Conclusions, to-wit: FINDINGS OF FACT 1. The applicant, Hilda Ward, has requested to her property rezoned from the existing R-l, Single Family zone to an R-2, Single Family zone. The property is located at 330 "V" Street SE. The property is 1.75 acres in size and contains one single family home. 2. The purpose of the rezone is to take advantage of the smaller lots allowed by the R-2 zone as opposed to the R-1 zone. The R-2 zone allows for 6,000 square foot lots while the R-1 zone requires lots of 8 000 square feet. The City annexed the property just a few years ago and annexed property automatically assumes an R-1 designation. The fezone is being processed concurrently with a preliminary plat for an eight lot single family subdivision. The existing home on the property is to remain and will occupy lot 1 of the plat. 3. The project also lies in the proximity of the Green River and associated floodplain and wetlands of the River. A shorelines permit is also required which is being processed concurrent with the preliminary plat and rezone. 4. The R-2 zone is consistent with the Comprehensive Plan and existing zoning in the area. To the west and south are existing single-family uses that are zoned R-2. The contents of the case file, #REZ 0002-98, and the environmental file, #SEP0006-98, of this project are hereby incorporated by reference and made part of the record of this hearing. CONCLUSIONS OF LAW The rezone may be approved in that it is consistent with the Comprehensive Plan Map designations, zoning and existing uses in the area. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone from R-1 (Single Family) to R-2 (Single Family) is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. The following described property located at 330 "V" Street SE, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned Ordinance No. 5149 September 9, 1998 Page 3 from R-1 (Single Family) to R-2 (Single Family) and legally described as follows: BEGINNING AT THE NORTHWEST CORNER OF LOT 1 OF KING COUNTY SHORT PLAT NO 181067 RECORDED UNDER AF# 8109150581 BEING THE TRUE POINT OF BEGINNING; THENCE S 00°46'59'' E A DISTANCE 172.00'; THENCE N 89055'00" E A DISTANCE 502.00 FEET MORE OR LESS TO THE EAST LINE OF BLOCK 4 OF PLAT OF EAST AUBURN GARDEN TRACTS; THENCE NORTHWESTERLY ALONG SAID EAST LINE TO A POINT WHICH BEARS N 89053'58" E FROM THE TRUE POINT OF BEGINNING; THENCE S 89053'58" W A DISTANCE 406.00 FEET MORE OR LESS TO THE TRUE POINT OF BEGINNING. Section 3. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section 4 The Mayor is hereby authorized to implement ' such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
