Assessor's Property Tax Parcel/Account Number: 212105-9043 [] Assessor Tax # not yet assigned ORDINANCE NO. 5 I 6 6 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 332X AUBURN WAY SOUTH, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM CN (NEIGHBORHOOD COMMERCIAL) TO C-1 (LIGHT COMMERCIAL). WHEREAS, Application No. REZ0003-98 has been submitted to the Council of the City of Auburn, Washington, by H.K. PROPERTIES, requesting the rezoning of the real property hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on September 22, 1998, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property; and Ordinance No. 5166 October 8, 1998 Page 1 WHEREAS, the City Council, on October 5, 1998 considered said request and affirmed the Hearing Examiner's recommendation for rezone based upon the following Findings of Fact and Conclusions, to-wit: FINDINGS OF FACT 1. The applicant, H.K. Properties, has requested to have its property located at 332X Auburn Way South rezoned from the existing zoning of CN, Neighborhood Commercial, to a C- 1, Light Commercial, zoning. The property is 1.76 acres in area and is currently vacant. 2. The property has a Comprehensive Plan map designation of Light Commercial. The Light Commercial designation was established on this property in 1995. The prior land use designation was Neighborhood Commercial. The purpose of the change to a Light Commercial designation was to provide for the opportunity to have the property zoned C-i, Light Commercial, which would be consistent with the Light Commercial designation, but not the Neighborhood designation. 3. The City determined that the existing CN zoning was not allowing for a wide enough range of commercial uses and the more restrictive development standards of the CN zone was not providing the ability for the parcel to successfully develop. Therefor, it was concluded that a C-1 zoning would allow for a wider range of commercial uses, but still be compatible with the adjoining multi-family and other commercial uses in the area. 4. The proponent has plans to development the project into two parcels. The larger parcel would contain a 13,320 square foot retail building and the second parcel is proposed to contain a 3,375 square foot building that may be a drive-in restaurant. The contents of the case file No. REZ003-98 and the environmental file No. SEP0011-98 of this project are hereby incorporated by reference and made part of the record of this hearing. CONCLUSIONS OF LAW The rezone may be approved in that the proposal is consistent with the Comprehensive Plan Map designation, zoning and existing uses in the area. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone from is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. The following described property located at 332X Auburn Way South, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby Ordinance No. 5166 October 8, 1998 Page 3 rezoned from CN (Neighborhood Commercial) to C-1 (Light Commercial) and legally described as follows: Lots 2, 3 and 4 of City of Auburn Short Plat 0003-95, as recorded under Recording No. 9508210641, records of King County. Section 3. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
