AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING
3 COUNTY, WASHINGTON, ESTABLISHING A MORATORIUM ON THE FILING OF
APPLICATIONS FOR BUSINESS LICENSES AND BUILDING PERMITS FOR
4 FOOD OR DRINK ESTABLISHMENTS CONDUCTING COMMERCIAL STIMULANT
CARD GAMES AND DECLARING AN EMERGENCY.

8 WHEREAS, the City is currently in the process of
7 reviewing and amending its zoning and land use code; and
8 WHEREAS, the City recently authorized interim zoning
9 ordinances on specific areas; and
10 WHEREAS, as part of this process, the City is evaluating
ll whether it will permit gambling activities in the future; and
12 WHEREAS, the City desires to preserve the status quo by
13 establishing a moratorium on the filing of applications for
14 business licenses for food or drink establishments conducting
15 commercial stimulant card games; and
16 WHEREAS, this moratorium is consistent with the
]7 comprehensive plan and has no adverse current affect; and
]8 WHEREAS, an emergency is declared to exist to allow the
19 immediate effectiveness of this Ordinance to treat all parties
20 equally to protect public health, safety and welfare.
21 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
22 KING COUNTY, WASHINGTON, DO ORDAIN AS FOLLOWS:
23 Section 1. MORATORIUM ESTABLISHED. A moratorium is

hereby established, effective immediately upon adoption of

1 this Ordinance, upon the filing of applications for business
2 licenses, building permits or any other permits or approvals
3 required for food or drink establishments conducting
4 commercial stimulant card games. No such applications shall
5 be accepted during the effective period of this moratorium.
6 Section 2. BUSINESS LICENSE REQUIRED. Any existing food
7
or drink establishment that has been issued a business license
8
shall be required to apply for an additional business license
9
to conduct commercial stimulant card games on the premises.

Section 3. EFFECTIVE PERIOD OF MORATORIUM. The
moratorium established by this Ordinance shall become

effective as set forth in Section 5 below, and shall continue
in effect for six months thereafter unless repealed, renewed

o~ modified by the City Council after a subsequent public
15
hearing and entry of findings of fact.
Section 4. SEVERABILITY. Should any section, paragraph,
17
18 sentence, clause or phrase of this Ordinance, or its
19 application to any person or circumstance, be declared
20 unconstitutional or invalid for any reason, or should any
21 portion of this Ordinance be pre-empted by state or federal
22 law or regulation, such decision or pre-emption shall not
23 affect the validity of the remaining portions of this

] Ordinance or its application to other persons or
2 circumstances.
3 Section 5. EFFECTIVE DATE. This Ordinance, as a public
4
emergency ordinance necessary for the protection of the public
5
health, public safety, public property, or public peace, shall
take effect and be in full force immediately upon its
7
adoption.

Section 6. HEARING DATE. A public hearing shall be held
9
on this moratorium January 19, 1999.
