AN ORDINANCE OF THE CITY OF AUBURN~ WASHINGTON, TO APPROPRIATE THE CITY'S
4 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) ENTITLEMENT FUNDS FOR 1999, IN THE
5 AMOUNT OF THREE HUNDRED AND SEVENTY-FIVE THOUSAND DOLLARS ($375,000), FOR THE
1999 PROGRAM YEAR; AND TO AUTHORIZE THE MAYOR TO IMPLEMENT THE APPROVED
6 PROGRAMS AND PROJECTS.

8 WHEREAS, the City Council of the City of Auburn must adop~ and approve all
9 appropriations by ordinance pursuant to Chapter 35A RC~r; and
10
WHEREAS, the City is an entitlement applicant for Community Development Block
11
Grant (CDBG) funds under the Housing and Community Development Act of
12
13 1974 (the Act), Pub. L. 93-383 as amended, and will receive CDBG funds for
14 the purpose of carrying out eligible community development and housing
15
activities under the Act and under regulations promulgated by the Department
16
of Housing and Urban Development (HUD) at 24 CFR Part 570; and
17
18 WHEREAS, the City desires to award certain funds for use as described within this
19 Ordinance, for the purpose of implementing eligible activities under the Act
20
and HUD regulations; and
21
22 WHEREAS, the Legislature has declared that carrying out the purposes of federal grants or
23 programs is both a public purpose and an appropriate function for a city,
24
town, county, or public corporation;

1 NOW THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO HEREBY

ORDAIN THE FOLLOWING:

4 SECTION 1. CDBG Budget for 1999 Program Year.
5 The City Council of the City of Auburn hereby approves 'the appropriation of
the City of Auburn's 1999 CDBG entitlement of Three Hundred Seventy-
Five Thousand Dollars ($375,000) for programs, projects, and administrative
7 costs recommended by the Human Service Committee and approved by the
Planning and Community Development Committee for the 1999 CDBG
8
program year. Specific expenditures for the 1999 Program Year are itemized
9 in Exhibit "A," attached hereto and incorporated herein by this reference.
Disbursement of CDBG funds for a specific program or project shall not
10
exceed the amount appropriated, as indicated on the itemized budget set forth
11 in Exhibit "A," to this Ordinance No. 5190 particular program or project.

13 SECTION 2. Prerequisites for Use of CDBG Funds.
14 Grant recipients must certify that their planned use of CDBG ~mds complies
with the following:
15
(a) Compliance with national objectives.
16 Grant recipients must certify that their use of CDBG funds gives
17 maximum feasible priority to activities that benefit low and moderate
income residents or aid in the prevention or elimination of slums or
18 blight.
19 (b) Compliance with environmental review procedures.
20 Grant recipients must certify their compliance with environmental
review procedures set forth in 24 CFR, part 58, for each activity as
21 applicable.

SECTION 3. Limitations on Expenditures and Adjustments.
23 No appropriation shall be made in excess of actual revenues and no liability is
24 to be incurred in excess of appropriations. In the event that actual revenues

are less than or different than the revenues estimated by the CDBG budget,
2 the following actions shall be taken:
3 (a) Public Service Programs:
In the event the City receives less than its budgeted CDBG
4 entitlement, each appropriation for public services will receive a
5 proportionately equal reduction in its appropriation relative to the
total decrease in total revenues. In the event the City receives more
6 than its budgeted CDBG entitlement, each appropriation for public
7 services will receive a proportionately equal increase in its
appropriation relative to that increase in revenues available for public
8 services.
9 (b) Neighborhood Revitalization and Public Facilities:
10 Appropriations for capital projects, including the Housing Repair
Program, shall be released in accordance to their respective budget
11 priority as provided in Exhibit "A" as set forth above. Appropriations
12 for each capital project shall be released only when actual revenues
are sufficient to fully fund the appropriation unless both the recipient
13 Agency and the City mutually agree to a partial funding of the
14 Agency's original appropriation. Partial funding of an appropriation
will release the City from further obligations to ftmd that particular
15 appropriation and, thereby, allow the City to consider funding either
16 all or part of the appropriation represented by the next budget priority.
17 In the event the City receives more than its budgeted CDBG
entitlement, the non budgeted portion of the appropriation not
18 available for public services will be provided to the Housing Repair
19 Program.
Funds budgeted to capital projects which are reduced in cost will be
20 reallocated to the Housing Repair Program.

SECTION 4. Implementation.

The Mayor is hereby authorized to implement such administa:ative procedures
23 as may be necessary to carry out the directives of this legislation.

1 SECTION 5. Severability.
2 The provisions of this ordinance are declared to be separate and severable.
3 The invalidity of any clause, sentence, paragraph, subdivision, section or
portion of this ordinance, or the invalidity of the application thereof to any
4
person or circumstance shall not affect the validity of the remainder of this
5 ordinance, or the validity of its application to other persons or circumstances.
6 SECTION 6. Effective Date:
7 This Ordinance shall be in force and take effect five (5) days from and after
its passage, approval and publication, as provided by law.

1999 CDBG Budget
Budget SOCIAL SERVICE PROGRAMS
Priority
Community Health Centers: $28,000
Health care and routine/emergency dental care to low and moderate
income people at the Auburn Community Health Center located at 105
"A" Street S.W., Auburn. {CDBG eligible under 24CFR570.201(e)}
Emergency Shelters and Transitional Housing: $15,250
Operational support for emergency shelters and transitional housing
units provided by the Seattle-King County YWCA for homeless people
at approximately 15 locations throughout Auburn. {CDBG eligible,,
under 24CFR570.201 (e)}
Child Care: $5,000
Subsidize child care services for the working parents of low and
moderate income families at ACAP Child and Family Services located
at 1102 "J" Street, Auburn. { CDBG eligible under 24CFR570.201 (e) }
Emergency Services: $8,000
Operational support for the Catholic Community Services' Emergency
Assistance Program that provides case management and financial
assistance to residents of Auburn for emergent needs such as
rent/shelter, food, clothing, utilities, gas, medicines, households goods,
furniture and referral to other social service agencies and community
proriders. {CDBG eligible under 24CFR570.201 (e) }
Budget NEIGHBORHOOD REVITALIZATION:
Priority
City of Auburn's Housing Repair Program: $114,750
Grants of less than $3,000 and/or loans of less than $10,000 for
necessary repairs and renovation of single family homes owned and
occupied by low and moderate income households at various locations
throughout Auburn. {CDBG eligible under 24CFR570,202}

Budget PUBLIC FACILITIES:

Auburn Senior Center, Relocation Study: $50,000
Pre-Construction phase for the Senior Center to relocate into the
remodeled library facility at 808 9th St. SE in Auburn. {CDBG eligible
under 24CFR570.201 (c) }
Auburn Youth Resources, Building Renovations: $39,000
Funds will be used to renovate and remodel AYR's present building, to
provide con~dentiality for clients and improve accessibility to and
inside the building. {CDBG eligible under 24CFR570.20 l(c)}
Habitat for Humanity of South King County: $40,000
Acquisition of site in Auburn for construction of home that will be sold.
at no profit, no interest, to a low-income family, using volunteer labor
and the homeowners' "sweat equity." {CDBG eligible under
24CFR570.201(a)}

Program Administration $75,000
Salary, benefits and program materials necessary to implement,
monitor and administer eligible CDBG activities. {CDBG eligible
