ORDINANCE NO. 5214
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
THE REZONING OF PROPERTY LOCATED AT 601 "M" Street NE, WITHIN
THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING
CLASSIFICATION THEREOF FROM "I" INSTITUTIONAL TO
RO(RESIDENTIAL OFFICE)
WHEREAS, Application No. REZ0001-98 has been submitted
to the Council of the City of Auburn, Washington, by Helen A.
Shaughnessy, requesting the rezoning of the real property
hereinafter described in Section 2 of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon;
and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on January 20, 1999, at the
conclusion of which the Hearing Examiner recommended the
approval of the rezoning of said property; and
WHEREAS, the City Council, on February 1, 1999,
considered said request and affirmed the Hearing Examiner's
recommendation for rezone based upon the following Findings of
Fact and Conclusions, to-wit:
FINDING OF FACT
1. The applicant, Helen A. Shaughnessy, has requested that
her property located at 601 "M" Street NE be rezoned
from existing zoning of "I",Institutional, to a proposed
RO, Residential Office Zoning. The property is 1.29
acres in size and currently contains a single family
home.
2. The subject property is illustrated on the Comprehensive
Land Use Map as Office Residential. The City recently
amended its Comprehensive Land Use map and at the
request of the applicant changed the map designation to
Office Residential. The previous designation was
Public/Quasi public. This was due in part to the subject
property being sandwiched in between a church to the
north and a park to the south.

It was determined that if the use of the existing
property were to convert to another use that the
Residential Office Zoning would be more appropriate.
The applicant has not indicated what the existing house
may be converted to.
3. The subject property abuts "M" St. NE, which is a
designated arterial and is heavily traveled. On either
side of "M" Street, from Main Street north to the
subject property, the Comprehensive Plan map
illustrates that those properties on either side of
"M" Street are designed as Office Residential.
Properties along "M" Street have been converting to
office use including a dental office across the street
from the subject property.
4. The contents of the case file #REZ0001-98 and the
environmental file #SEP0004-98 of this project are
hereby incorporated by reference and made part of the
record of this hearing.
CONCLUSIONS OF LAW
The rezone may be approved in that the proposal is consistent
with the Comprehensive Plan Map designations, zoning and
existing uses in the area.
For each of the above reasons, the recommendation of the
Hearing Examiner to the Auburn City Council on this rezone
form is approved.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOW:
Section 1. The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.

Section 2. The following described property located at
601 "M" Street NE, situate in the City of Auburn, County of
King, State of Washington, be and the same is hereby rezoned
from "I" Institutional to RO (Residential Office) and legally
described as follows:

Section 3. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor, Division of Records and
Elections.
Section 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 5. This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
