AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON,
AMENDING ORDINANCE NO. 4689 THAT PROVIDED A
CONDITIONAL USE PERMIT TO CONSTRUCT AND OPERATE A
THOROUGHBRED HORSE RACING FACILITY, TO AMEND SECTION
2, SUBSECTION 22 TO ALLOW TEMPORARY EVENTS TO BE HELD
AT THE EMERALD DOWNS TRACK.
WHEREAS, Ordinance No. 4689 which regulates the
Emerald Downs Race Track, establishes the uses that
are allowed in addition to thoroughbred racing; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 4689 is hereby amended
as follows to allow temporary events at Emerald Downs
horse racing facility located south of 37th Street
N.W., between the Union Pacific and Burlington
Northern Railroad tracks, and north of 15th Street
N.W.
22. This permit shall allow for a
thoroughbred horse racing facility and its
attendant and accessory uses. Temporary
events such as car sales, car shows,
carnivals, circuses or fairs may be allowed.
Other similar temporarV events, excludin~ any
racing event, may be allowed as determined by
the Planning Director. The temporary event

must be clearly incidental to the racetrack
and it cannot qenerate any more traffic,
noise, or other impacts than what were
Dreviously analyzed and aDproved for the
racetrack itself. Each temporary event must
receive an administrative temporary use
permit pursuant to Section 18.46.060(B) of
the Zoninq Ordinance and otherwise meet all
aDDlicable regulations of the CitV. During
the off-racing season, satellite (simulcast)
racing is permitted. No other forms of
gambling than pari-mutuel wagering for live
and satellite horse racing shall be allowed.
During the off-season, the restaurants,
meeting rooms and related facilities may be
used for non-racing functions. All other uses
must be as allowed by the underlying zoning
on the property.
Section 2. Upon the passage, approval and
publication of this Ordinance as provided by law, the
City Clerk of the City of Auburn shall cause this
Ordinance to be recorded in the office of the King
County Auditor.
Section 3. The Mayor is hereby authorized to
implement such administrative procedures as may be
necessary to carry out the directions of this
legislation.

Section 4. This Ordinance shall take effect and
be in force five days from and after its passage,
approval and publication as provided by law.
