HomeMy WebLinkAbout5235 ORDINANCE NO. 5 2 3 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE CONVERSION TO, AND DONATION OF ONE MERIDIAN TELEPHONE SYSTEM AS SURPLUS PERSONAL PROPERTY OWNED BY THE CITY OF AUBURN TO THE FRED HUTCHINSON CANCER RESEARCH CENTER AS AUTHORIZED BY ARTICLE 8, SECTION 7 OF THE CONSTITUTION OF WASHINGTON ENTITLED "CREDIT NOT TO BE LOANED", RCW 35A.79.010 ENTITLED "POWERS TO ACQUIRE, USE AND MANAGE" AND RCW 35A.11.020 ENTITLED "POWERS VESTED IN LEGISLATIVE BODIES OF NONCHARTER AND CHARTER CODE CITIES". WHEREAS, the Washington Constitution Article 8, Section 7 entitled "Credit not to be loaned" provides that a municipal corporation may give property for the necessary support of the poor and infirm; and' WHEREAS, RCW 35A.79.010 entitled "Powers to acquire, use and manage" provides that a code city shall have the power to dispose of municipal property, both real and personal; and WHEREAS, RCW 35A.11.020 entitled "Powers vested in legislative bodies of noncharter and charter code cities" provides that any code city may exercise its powers in regard to the sale of personal property; and WHEREAS, the Fred Hutchinson Cancer Research Center is a non-profit cancer medical research organization the serving cancer patients from all socio-economic groups including the poor and infirm; and Ordinance No. 5235 Date April 30, 1999 Page 1 WHEREAS, the City of Auburn Finance Department is converting to surplus public personal property one Meridian Telephone system, described in Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, the Fred Hutchinson Cancer Research Center has indicated that it has a need for the telephone' system as described in Exhibit "A" for use at its cancer research facility. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. PURPOSE. The purpose of this Ordinance is as follows: To authorize the conversion to surplus personal property one Meridian telephone system and for the donation of that surplus personal property to Fred Hutchinson Cancer Research Center as provided by the Constitution of Washington Article 8, Section 7, RCW 35A. 79.010 and RCW 35A. 11.020. Section 2. Constitutionality or Invalidity. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it being hereby expressly declared that this Ordinance and each section, Ordinance No. 5235 Date April 30, 1999 Page 2 subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation.
