AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, REPEALING ORDINANCE NUMBER 5248 AS IT
CONTAINED AN INCORRECT EFFECTIVE DATE AND ENACTING A NEW
ORDINANCE AMENDING AUBURN CITY CODE SECTION 9.01.010
ENTITLED, "ADOPTED - COPIES FILED AND AUTHENTICATED",
CONTAINED IN CHAPTER 9.01 ENTITLED "SPECIFIED WASHINGTON
CRIMINAL STATUTES ADOPTED BY REFERENCE", WHICH IS CONTAINED
IN TITLE 9 ENTITLED "PUBLIC PEACE, MORALS AND WELFARE", TO ADD
REFERENCES TO RCW TITLE 66 "ALCOHOLIC BEVERAGE CONTROL"
AND RCW TITLE 69 "FOOD, DRUGS, COSMETICS AND POISONS".
WHEREAS, the Auburn City Council passed Ordinance 5248 amending
Section 9.01.010 entitled "Adopted--Copies filed and authenticated" to Title 9
to add references to RCW Title 66 "ALCOHOLIC BEVERAGE CONTROL" and
RCW Title 69 "FOOD, DRUGS, COSMETICS AND POISONS" at the June 7,
1999 Auburn City Council meeting; and
WHEREAS, Ordinance 5248 contained an incorrect effective date; and
WHEREAS, it is necessary to repeal Ordinance 5248 and enact a new
ordinance which contains a corrected effective date; and
WHEREAS, references to RCW Title 66, "Alcoholic Beverage Control"
and Title 69, "Food, Drugs, Cosmetics and Poisons" are added to Auburn City
Code Section 9.01.010, "Specified Washington Criminal Statutes Adopted by

Reference" because specific sections of those RCW titles have been adopted
by reference into Auburn City Code Title 9;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. PURPOSE. The purpose of this Ordinance is as follows:
To repeal Ordinance 5248 which contained an incorrect effective date
and to enact a new Ordinance which amends Auburn City Code Section
9.01.010 entitled "Adopted--Copies filed and authenticated" contained in
Chapter 9.01 entitled "Specified Washington Criminal Statutes Adopted By
Reference", contained in Title 9 entitled "Public Peace, Morals and Welfare As
Adopted", to include references to RCW Title 66 "Alcoholic Beverage Control"
and RCW Title 69 "Food, Drugs, Cosmetics and Poisons".
Section 2. AMEND SECTION 9.01.010 OF AUBURN CITY CODE.
Section 9.01.010 entitled "Adopted--Copies filed and authenticated" contained
in Chapter 9.01 entitled "Specified Washington Criminal Statutes Adopted by
Reference" contained in Title 9 entitled "PUBLIC PEACE, MORALS AND
WELFARE AS ADOPTED" is hereby amended as set forth in Exhibit "A"
attached hereto and incorporated herein by this reference.

Section 3. Constitutionality or Invalidity. If any section, subsection,
clause or phrase of this Ordinance is for any reason held to be invalid or
unconstitutional, such invalidity or unconstitutionality shall not affect the validity
or constitutionality of the remaining portions of this Ordinance, as it being
hereby expressly declared that this Ordinance and each section, subsection,
sentence, clause and phrase hereof would have been prepared, proposed,
adopted and approved and ratified irrespective of the fact that any one or more
section, subsection, sentence, clause or phrase be declared invalid or
unconstitutional.
Section 4. The amendment of Section 9.01.010, "Adopted--Copies
filed and authenticated" contained in Chapter 9.01 entitled "Specified
Washington Criminal Statutes Adopted by Reference" contained in Title 9
entitled "Public Peace, Morals and Welfare as Adopted" does not affect existing
litigation and does not operate as an abatement or bar to any action or
proceeding pending under or by virtue of the repealed ordinance.
Section 5. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directions of
this legislation.

Section 6. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.
