AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AMENDING THE AUBURN CITY CODE CHAPTER 3.40
ENTITLED "WATER AND SEWER UTILITY TAX" TO REFLECT THE
REQUIREMENTS OF AUBURN CITY CODE SECTION 13.48.020 ENTITLED
"ESTABLISHED".
WHEREAS, the City of Auburn desires to consolidate all utility taxes into
Auburn City Code Chapter 3.40 presently titled "Water and Sewer Utility Tax";
and
WHEREAS, Ordinance No. 4193, approved and passed at a regular
Council Meeting on December 21, 1986 established a storm drainage utility and
the authority to establish rates and charges for such utility and was codified in
Auburn City Code Chapter 13.48 entitled "Storm Drainage Utility"; and
WHEREAS, minor reorganization of Auburn City Code Chapter 13.48
entitled "Storm Drainage Utility" was adopted in Ordinance No. 4492 which
repealed and reenacted Auburn City Code Chapter 13.48 and was approved
and passed at a regular Council Meeting on March 18, 1991;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. PURPOSE. The purpose of this ordinance is as follows:
To amend Auburn City Code Chapter 3.40, presently entitled "WATER
AND SEWER UTILITY TAX" by adding specific references to the storm

drainage utility". Chapter 3.40 of the Auburn City Code is hereby amended as
set forth in Exhibit "A" attached hereto and incorporated herein by reference.
Section 2. CONSTITUTIONALITY OR INVALIDITY: If any section,
subsection, clause, phrase, or sentence, of this Ordinance, is for any reason
held to be invalid or unconstitutional, such invalidity or unconstitutionality of the
remaining portions of this ordinance, as it is being hereby expressly declared
that this ordinance and each section, subsection, clause, phrase, or sentence,
hereof would have been prepared, proposed, adopted, and approved and
ratified irrespective of the fact that any one or more section, subsection, clause,
phrase, or sentence, be declared invalid or unconstitutional.
Section 3. IMPLEMENTATION. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out
the directions of this legislation.
Section 4. EFFECTIVE DATE. This ordinance shall take effect and
be in force five (5) days from and after its passage, approval, and publication,
as provided by law.

WATER, STORM DRAINAGE AND SANITARY SEWER UTILITY TAX

There is created a tax in the amount of four and one-half percent effective
January 1, 1987, against and upon the total annual revenues of the water, storm
drainage and sewer utility funds. (Ord. 4178 § 2, 1986.)
3.40.020 Levy and collection.
There is levied a tax of four and one-half percent per year upon the total
annual revenues of the water, storm draina.qe and sanitary sewer utility funds,
which tax shall be collected from and levied upon the total revenues received by
the water, storm drainage and sanitary sewer utility funds, for the benefit of the
current expense fund. The finance director is directed to collect the tax of four
and one-half percent out of the total revenues received each year in the wateri
storm drainage and sanitary sewer utility funds, commencing January 1, 1987,
and the finance director is directed to pay over the funds so collected into the
current expense fund. (Ord. 4178 § 2, 1986.)
