HomeMy WebLinkAbout5308 ORDINANCE NO. 5 3 0 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, ,WASHINGTON AMENDING SECTION 2.78.010 ENTITLED "FEE DESIGNATED", CONTAINED IN AUBURN CITY CODE CHAPTER 2.78 ENTITLED "FEES FOR CITY PERMITS AND ACTIONS" TO ESTABLISH A FEE STRUCTURE AND REPLACEMENT COSTS FOR MOUNTING BOARDS USED IN THE POSTING OF PUBLIC NOTICES. WHEREAS, the City Council of the City of Auburn finds that development activity in the City of Auburn creates the demand and need for the establishment of a fee structure and replacement costs for mounting boards used in the posting of public notices; and WHEREAS, Auburn City code Section 2.78.010 entitled "Fee Designated" contained in Chapter 2.78 entitled "Fees for City Permits and Action" provides for the establishment of a fee structure and replacement costs ,for mounting boards used in the posting of public notices; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. The purpose of this ordinance is as follows: To amend Auburn City Code Section 2.78.010 entitled "Fee Designated" contained in Chapter 2.78 entitled "Fees for City Permits and Action" as set forth in Exhibit "A" attached hereto and incorporated herein by this reference. Ordinance 5308 October 22, 1999 ' Page ! Section 2. Constitutionality or Invalidity. If any section, subsection clause or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that nay one or more section, subsection, sentence, clause or phase be declared invalid or unconstitutional. Section 3. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. Effective Date. This Ordinance upon passage, approval and publication shall take effect and be in force from and after January 1, 2000. The fee structure for posting public notices, Chapter 1.27 ACC, is as follows: Type of Mountinq Board Fee. Per Board Replacement Cost, Per Board Type I $20.00 $50.00 Type II $30.00 $75.00 Type III $50.00 ,$100.00 The fee structure of the current city sign provisions, Chapter 18.56 ACC, is as follSws: A fee shall accompany each application for a sign permit, unless specifically exempt by Chapter 18.56 ACC. The amount of the fee shall be based upon.the'value of the sign 'pursuant to the provisions contained within Table l-A, Chapter 1 of the 1997 Uniform Building Code, as amended, as published by the International Conference of Building Officials. Applications for actions as set forth in ACC 2.78.010 shall not be accepted for filing until the above fee schedules have been paid to the city.
