WHEREAS, Petition No. V-04-99 has been filed by the owners of two- thirds or more of the property abutting the portion of right of way requested to be vacated; and Ln o WHEREAS, the statute requires that the City Council schedule a public C=3 Cr N hearing when a valid petition is filed with the City; and CG WHEREAS, the public hearing was held on June 5, 2000, before the City a ,n Q Council; CV NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the street right-of-way located on 'B' Street SW between 2nd Street SW and 31 Street SW and the Alley connecting this portion of 'B' Street SW to 'A' Street SW, is legally described on attached Exhibit "A" and incorporated by reference herein, be and the same is hereby vacated, and the property lying in said portion of a certain street right of way described Ordinance No. 5408 06/07/00 Page 1 hereinabove, shall be returned and belong to those persons entitled to receive the property in accordance with the law. Section 2. The petitioner at their expense shall relocate the existing utilities to the satisfaction of the City. The City shall retain a utility easement for the operation, repair and maintenance of all public utilities over, across, upon and underneath that portion of the property described in Section 1 of this Ordinance until such time as the relocation of the existing utilities by the petitioner is completed. Said easement shall be released when the utilities have been relocated to the City's satisfaction. Section 3. Upon the passage, approval and publication of this a Ordinance, the City Clerk for the City of Auburn shall cause this Ordinance to Cn N be recorded in the office of the King County Auditor. CnC= o Section 4. The Mayor is hereby authorized to implement such 0 administrative procedures as may be necessary to carry out the directives of this legislation.
