Assessor Tax # not yet assigned ORDINANCE NO. 5 5 2 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 526 "M" STREET NE WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION FROM R-2 (SINGLE FAMILY) TO R-O (RESIDENTIAL OFFICE). WHEREAS, Application No. REZ00-0008 dated December 12, 2000, has been submitted to the City of Auburn, Washington, by Pat Gustaves requesting the rezoning of the real property located at 526 "M" Street NE from R-2 (Single Family) to R-0 (Residential Office) and hereinafter described below a" and as identified on Exhibit "A" attached hereto and incorporated in this o Ordinance by this reference; and WHEREAS, said request above referred to the Hearing Examiner for co study and public hearing thereon; and C?A 0 WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider the request in the Council Chambers of Auburn City Hall on February 22, 2001, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property; and WHEREAS, the City Council, on March 5, 2001, considered said request and affirmed the Hearing Examiner's recommendation for rezone based upon the following Findings of Fact and Conclusions of Law and Decision, to-wit: Ordinance 5523 March 12, 2001 Page 1 FINDINGS OF FACT 1. Pat Gustaves, the owner of the property located at 526 "M" Street NE, has requested that his property be rezoned from its existing zoning of R2, Single Family to an RO Residential-Office zone. The property contains a single family home and the lot is ,7350 square feet in area. 2. The lot is located at the northeast corner of "M" Street and 6th Street NE. Most of the properties along either side of "M" Street from Main Street to 8th Street NE are designated on the City's Comprehensive Plan as being appropriate for Residential Office zoning. The subject parcel is also located within this planned residential office area along "M" Street NE. 3. The property owner has not brought forth any specific proposal if the property is zoned RO. When any conversion of the single family home m occurs, the site will need to meet applicable City standards including N improving the abutting street, providing adequate on-site parking, cm, landscaping, storm drainage, etc. 0 4. The contents of the case file, #REZ00-0008, and the environmental file, .mss #SEP00-0054, of this project are hereby incorporated by reference and m made part of the record of this hearing. N CM CONCLUSIONS OF LAW The undersigned has concluded that the rezone may be approved in that the proposal is consistent with the Comprehensive Plan Map designations, zoning and existing uses in the area. DECISION For each of the above reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone application is approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance 5523 March 12, 2001 Page 2 Section 1. Purpose. The above-cited Hearing Examiner's Findings of Fact, Conclusions of Law and Decision, are herewith incorporated in this Ordinance. Section 2. The following property located at 526 "M" Street NE and identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference, in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from R-1, (Single Family) to R-O, (Residential- Office). ote Section 3. Severability. The provisions of this ordinance are declared 0 to be separate and severable. The invalidity of any clause, sentence, c ecs o paragraph, subdivision, section or portion of this ordinance, or the invalidity of ca N the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Recording. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Effective date.
