HomeMy WebLinkAbout5548ORDINANCE NO. 5 5 4 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING ORDINANCE 5421 TO AUTHORIZE ACCEPTANCE OF AN INCREASE IN THE U. S. DEPARTMENT OF TRANSPORTATION, FEDERAL AVIATION ADMINISTRATION AIRPORT IMPROVEMENT PROGRAM GRANT NUMBER 3-53-0003-10, CONTRACT NUMBER DOT-FAOO-NM-0028 FUNDING FROM AN AMOUNT OF ONE HUNDRED SIXTY THOUSAND SIX HUNDRED FORTY-NINE DOLLARS ($160,649.00) TO A TOTAL OF ONE HUNDRED SIXTY FIVE THOUSAND FOUR HUNDRED SEVEN DOLLARS ($165,407.00), AN INCREASE OF FOUR THOUSAND SEVEN HUNDRED FIFTY EIGHT DOLLARS ($4,758,00), AND EXPENDITURE OF CITY OF AUBURN MATCHING SHARE FUNDS OF FIVE HUNDRED FORTY NINE DOLLARS AND NINETY CENTS ($549.90) FOR THE PURPOSE OF PAYING FOR THE COST TO ACQUIRE AND INSTALL PERIMETER FENCING ON THE WEST BOUNDARY OF THE AUBURN MUNICIPAL AIRPORT. WHEREAS, the Auburn City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to chapter 35A.33 RCW; and WHEREAS, On July 17, 2000 the City Council of the City of Auburn adopted Ordinance No. 5421 authorizing the acceptance of Grant No. 3-53- 003-10 from the Federal Aviation Administration (FAA) in the amount of $160,649.00; and WHEREAS, On March 12, 2001 the City of Auburn requested an increased amount in the FAA Grant No. 3-53-0003-10 funding for the purpose Ordinance 5548 May 18, 2001 Page 1 of funding the cost of purchase and installation of security fencing that is beyond the original scope of the airport fencing project; and WHEREAS, on April 16, 2001 the City of Auburn Request was approved by the FAA to increase the FAA Grant in the amount of $4,758.00 for the cost of the additional fencing; and WHEREAS, the required matching share to be paid by the City of Auburn for the cost of the increased funding is in the amount of $549.00; and WHEREAS, the City of Auburn Airport budget has sufficient funds to pay the required matching share of $549.00. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: Section 1. Purpose. Pursuant to Chapter 35A.33 RCW the City Council hereby authorizes the execution of an amendment to City of Auburn Ordinance No. 5421 to authorize the acceptance of an increase in the U.S. Department of Transportation, Federal Aviation Administration Airport Improvement Program Grant 3-53-0003-10, Contract Number DOT-FAOONM-0028 funding in the amount of Four Thousand Seven Hundred Fifty Eight Dollars ($4,758.00), and authorizes the total Airport Improvement Program Grant 3-53-0003-10, Contract Ordinance 5548 May 18, 2001 Page 2 Number DOT-FAOONM-0028, appropriation from the U.S. Department of Transportation, Federal Aviation Administration to Increase the Total Grant to One Hundred Sixty Five Thousand, Four Hundred Seven Dollars ($165,407.00) for the City of Auburn Municipal Airport and approves the City of Auburn expenditure of matching share funds in the amount of Five Hundred forty-nine Dollars Ninety Cents ($549.90) for the purpose of funding the cost of purchase and installation of security fencing that is beyond the original scope of the Auburn Municipal Airport security fencing project.. A copy of said Airport Grant Increase for the Auburn Municipal Airport is attached hereto as Exhibit "A" and is incorporated herein. Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 3. Constitutionality or Invalidity. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause or phrase hereof would have been prepared, Ordinance 5548 May 18, 2001 Page 3 proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 4. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. 5} DATED and SIGNED this o1) Day of May, 2001. In accordance with Special Condition No. 12 of the subject grant, the maximum obligation of the United States as shown in Condition No. 1 on Page 2 of Part I - Offer is increased from $160,649.00 to $165,407.00, an increase of $4,758.00. The purpose of this amendment is to cover the Federal share of total actual costs determined to be eligible and allowable project costs. All other terms and conditions of the Grant Agreement remain in full force and effect. Under the terms of the Grant Agreement, this document is incorporated into and constitutes Amendment No. 1 to the above referenced Grant Agreement. Sincerely, J.
