Assessor's Property Tax Parcel/Account Number 215400-0060 [] Assessor Tax # not yet assigned ORDINANCE NO. 5 5 6 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1806 - 2nd STREET SE WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION FROM R-1 (SINGLE FAMILY) TO R-2 (SINGLE FAMILY). WHEREAS, Application No. REZ01-0003 dated April 13, 2001, has been submitted to the City of Auburn, Washington, by Shelley Lee Watson requesting the rezoning of the real property located at 1806 - 2nd Street SE from R-1 (Single Family) to R-2 (Single Family) and hereinafter described below and as identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference; and WHEREAS, said request above referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider the request in the Council Chambers of Auburn City Hall on June 19, 2001, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property; and WHEREAS, the City Council, on July 2, 2001, considered said request and affirmed the Hearing Examiner's recommendation for rezone based upon the following Findings of Fact and Conclusions of Law and Decision, to-wit: Ordinance 5568 July 5, 2001 Page 1 FINDINGS OF FACT 1. Shelley Lee Watson the owner of the property at 1806-2nd Street SE has requested that her property be rezoned from the existing zoning of R-1 single family to R-2 single family. While both the R-1 and R-2 zones are single family zones, the principal difference between the two is that the R-1 zone has a minimum lot size of 8,000 square feet and the R-2 zone has a minimum lot size of 6,000 square feet. 2. The subject property is approximately 35,100 square feet in area and contains one single family home that is proposed to be demolished. The property has frontage on 2nd Street as well as "T" Street SE. There is 117.3 feet of frontage on 2nd Street and 299.3 feet of frontage on "T" Street. The property is mostly rectangular in shape. 3. The property has the potential to be subdivided. If the property were to retain its R-1 zoning only 3 lots could be attained. This is primarily due to the R-1 zone having a minimum lot width requirement of 75 feet. The R-2 zone has a minimum lot width requirement of 60 feet that could result in a 4-lot subdivision. 4. The Comprehensive Land Use Plan designation for the subject property and surrounding area is single family. This designation is appropriate for either the R-1 or the R-2 zoning. R-2 zoning is to the west, south and north. R-1 zoning is to the east. 5. The contents of the case file #REZ01-0003 and the environmental file #SEP01-0017 of this project are hereby incorporated by reference and made part of the record of this headng. CONCLUSIONS OF LAW The undersigned has concluded that the rezone may be approved in that the proposal is consistent with the Comprehensive Plan Map designations, zoning and existing uses in the area. DECISION For each of the above reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone application is approval Ordinance 5568 July 5, 2001 Page 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. The above-cited Headng Examiner's Findings of Fact, Conclusions of Law and Decision, are herewith incorporated in this Ordinance. Section 2. The following property located at 1806 - 2nd Street SE and identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference, in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from R-l, (Single Family) to R-2, (Single Family). Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Recordin,q. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Ordinance 5568 July 5, 2001 Page 3 Section 5. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
