AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AMENDING AUBURN CITY CODE 2.03.040 TO IDENTIFY
SPECIFIC CITY APPOINTIVE OFFICERS AND REQUIRING THE MAJORITY
OF ALL CITY COUNCIL MEMBERS TO APPROVE THE APPOINTMENTS.
WHEREAS, the City of Auburn is organized under the optional Municipal
Code, Title 35A RCW; and
WHEREAS, the current City Code allows the mayor to appoint, and at
his pleasure, remove all appointive officers, subject to the provisions of any
applicable law, rule or regulation pertaining to civil service, state law or city
ordinances; and
WHEREAS, the current City Code allows the mayor to designate all
department heads; and
WHEREAS, the current City Code does not define appointive officers;
and
WHEREAS, the current City Code requires Council confirmation of some
department heads and positions, while not requiring Council confirmation for
other department heads; and
WHEREAS, the current City Code requires discussion, in executive
session, to precede confirmation of appointments; and

WHEREAS, for effective administration of the City, it is in the public
interest to identi~ what City positions are appointive in nature and require
individuals appointed to those positions be confirmed by a majority of all
members of the City Council.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section I. That the City of Auburn Code 2.03.040 be amended to
read, "The mayor shall appoint, subject to confirmation by a majority of all
members of the city council, and at his pleasure may remove, all city appointive
officers, subject to the provisions of any applicable law, rule or regulation
pertaining to civil service, state law or city ordinances. Appointive officers are
as follow: Airport Supervisor, City Attorney, Assistant City Attorney, Acting City
Attorney, City Clerk, Deputy City Clerk (2), City Engineer, Finance Director,
Hearing Examiner, Human Resources Director, Parks and Recreation Director,
Planning and Community Development Director, Public Works Director, Police
Chief, Assistant Police Chief, Fire Chief and Assistant Fire Chief." - as set forth
in Exhibit "A" attached hereto and incorporated by reference.

appointive officers, and sets forth the requirement that all future appointments

to those positions be confirmed by a majority of all the members of the City
Council.
Section ;). The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directions of
this ordinance.
Section 4. This Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.
