HomeMy WebLinkAbout5599ORDINANCE NO. 5 5 9 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, REPEALING AUBURN CITY CODE CHAPTER 2.69 ENTITLED "PUBLIC LIBRARY" AND CREATING AUBURN CITY CODE CHAPTER 2.69 ENTITLED "CITY OF AUBURN LIBRARY BOARD". WHEREAS, in February, 1997, the citizens of the City of Auburn voted to annex to the King County Library System, a separate taxing district providing library services; and WHEREAS, the City Council desires to continue to retain the services of a Board of Commissioners to advise the Council in matters pertaining to library services in the City of Auburn; and WHEREAS, the current City Code Chapter 2.69 entitled "Public Library" does not reflect the parameters of the duties and membership of the Auburn Library Board of Commissioners; and WHEREASE, the City Council desires to create a new Auburn City Code Chapter 2.69 entitled "City of Auburn Library Board" for the purpose of delineating the duties and membership role of the Auburn Library Board of Commissioners; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DOES ORDAIN AS FOLLOWS: Section 1. Purpose: The purpose of this Ordinance is to repeal Auburn City Code Section 2.69 entitled "Public Library" as set forth in Exhibit Ordinance 5599 November 1, 2001 Page 1 of 3 "A" attached hereto and incorporated herein and to replace it with Auburn City Code Section 2.69 entitled "City of Auburn Library Board", as set forth in Exhibit "B" attached hereto and incorporated herein. Section 2. Constitutionality or Invalidity: If any section, subsection, clause, phrase, or sentence of this Ordinance is, for any reason, held to be invalid or unconstitutional, the remaining portions of this ordinance shall remain in force and affect. Section 3. Implementation: The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 4. Effective Date: This Ordinance shall take effect and be in force five (5) days from and after its passage, approval, and publication as provided by law. "Library" or "libraries" means the public library or libraries in the City. B. "Board" means the library commissioners. C. "Trustees" means the Board of Trustees of the King County Library System or other contracted governmental unit. 2.69.020 Creation In February, 1997, citizens of Auburn voted to annex to the King County Library System (KCLS), a separate taxing district, providing library services for citizens. 2.69.030 Created — Membership There is created a board of library commissioners, consisting of seven members, who shall be appointed by the mayor with consent of the city council from citizens of recognized fitness for such position. No commissioner shall receive any compensation for service. 2.69.040 Board of Commissioners — Terms The five library commissioners presently serving shall complete their current terms of office. The length of service of the additional two commissioners, appointed under the terms of the ordinance codified in this section, shall be determined by lot as to whose term will expire in two and four years respectively. Their terms shall begin after their appointment has been approved by the city council. Terms of office for all commissioners, at the expiration of their initial term, shall become five-year terms. Ordinance 5599 — Exhibit "B" November 1, 2001 Page 1 of 3 No commissioner shall serve more than two consecutive five-year terms. 2.69.050 Board of commissioners — Vacancy filling Vacancies in the board shall be filled for the un -expired terms or for new terms as soon as possible by the mayor with the consent of the city council. 2.69.060 Board of commissioners — Member Removal A library commissioner may be removed by the vote of the majority of the entire council at a regular or special meeting called for that purpose upon three days' notice, which shall provide that such matter will be considered at said special or regular meeting. A commissioner shall forfeit their position for three successive and unexcused absences from board meeting and upon notice thereof. The vacancy thereby created shall be filled in the same manner in which members of the board are regularly chosen. 2.69.070 Board of commissioners — Annual report At the close of each year the board shall make a report to the city council showing the state of the library and such other statistics and information and suggestions as it deems of public interest. 2.69.080 Board of commissioners — Powers and Duties The commissioners annually, and at such other times as may be necessary, shall meet for organization by the election of such officers as they deem necessary. They shall: A. Adopt such bylaws, rules and regulations for their own guidance as they deem necessary; B. Provide input and make recommendations to the Trustees regarding the policies and procedures necessary to best serve the library needs of the community. C. Promote library programs and policies and advocate for support of the library; D. Accept such gifts of money or property for library purposes as they deem appropriate; 2.69.090 Property destruction — Penalty Whoever intentionally injures, defaces, or destroys any property belonging to or deposited in the library is guilty of a misdemeanor and shall be punished in accordance with ACC 1.24.010. 2.69.100 Contract service Nothing in this chapter shall prevent the city council from securing library service from another governmental unit, and in like manner the city council shall have the power to contract for like service from any library not maintained by a public corporation to the extent permissible by state law as now existing or hereafter amended. Ordinance 5599 — Exhibit T" November 1, 2001 Page 2 of 3 2.69.110 Use of money or property Any money or property given to or for the use or benefit of the library and vested in the board of commissioners shall be held and used by the Board according to the terms of the gift, but all money or property given to the board of commissioners for the use or benefit of the library for which no express purpose has been given other than for library purposes shall be used for such library purposes as may be deemed appropriate by the board of library commissioners.
