WHEREAS, Application No. REZ01-0004 dated July 9, 2001, has been submitted to the City of Auburn, Washington, by HARVEY AND ROBIN WALKER, requesting the rezoning of the 1.86 acre parcel of land AT 916 22nd street NE from R-2 (SINGLE FAMILY) to R-4 (MULTI -FAMILY) and hereinafter oma, described below and as identified on Exhibit "A" attached hereto and 0 incorporated in this Ordinance by this reference; and 0 o WHEREAS, said request above referred to the Hearing Examiner for 0 N study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider the request in the Council Chambers of Auburn City Hall on October 16, 2001, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property; and WHEREAS, the City Council, on November 5, 2001, considered said request and affirmed the Hearing Examiner's recommendation for rezone Ordinance 5603 November 6, 2001 Page 1 based upon the following Findings of Fact and Conclusions of Law and Decision, to -wit: FINDINGS OF FACT Harvey and Robin Walker have requested that their property located at 916 -22nd Street NE be rezoned from its existing zoning of R-2, Single Family, to R-4, Multi -family. The property is 1.86 acres in area and contains one single family home. 2. The City of Auburn Comprehensive Land Use Map illustrates the property as high density multi -family residential which is appropriate for R-4 zoning. The R-4 zone requires that 2,400 square feet of lot area be provided for each dwelling unit. In the subject case the 1.86 acre parcel has the potential for 33 multi -family dwelling units. 3. The subject property is adjacent to a single-family neighborhood to the east Ln that is zoned R-2, Single Family. The R-4 zone at Section 18.18.050(A)(B) o requires additional setbacks for multi -family structures next to an R-2 zone. 0o A 30 -foot setback shall be provided for 3 and 4 unit structures and a 50- o foot setback shall be provided for multi -family structures that have more than 4 units per structure. All parking areas shall be setback at least 30 o feet. A 5 -foot width of landscaping will also be required next to the R-2 o zoned property. 0 C.4 4. The shape of the property is somewhat long and narrow. It has 68 feet of frontage on 22nd Street and the property is approximately 577 feet deep. The width of the property at its widest point is about 135 feet. The property also has a 35 -foot access to "I" Street, which is to the west. Due to the physical characteristics of the site together with the additional setbacks that are required and the access and parking requirements, it is not likely that 33 units could be built even though that is what the Zoning code allows. 5. The contents of the case file #REZ01-0004 and the environmental file #SEP01-028 of this project are hereby incorporated by reference and made part of the record of this hearing. Ordinance 5603 November 6, 2001 Page 2 CONCLUSIONS OF LAW The undersigned has concluded that the rezone may be approved in that the proposal is consistent with the Comprehensive Plan Map designations, zoning and existing uses in the area. DECISION For each of the above reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this rezone application is approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, o WASHINGTON, DO ORDAIN AS FOLLOWS: rn � Section 1. Purpose. The above-cited Hearing Examiner's Findings of 0 cl� Fact, Conclusions of Law and Decision, are herewith incorporated in this 0 0 "' Ordinance. Section 2. The following property located at 916 22nd Street NE and identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference, in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from R-2, (Single Family) to R-4, (Multiple Family). Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity Ordinance 5603 November 6, 2001 Page 3 of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Recording. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor.
