HomeMy WebLinkAbout5616ORDINANCE NO. 5616 AN ORDINANCE OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, ESTABLISHING A MORATORIUM ON THE LOCATION OF WIRELESS AND/OR CELLULAR TOWERS IN A P-1 ZONE FOR A PERIOD OF FOUR MONTHS, DECLARING AN EMERGENCY TO ALLOW IMMEDIATE PASSAGE, SETTING FORTH FACTS, ESTABLISHING A PUBLIC HEARING FOR JANUARY 7, 2002. WHEREAS, a request by a wireless telecommunications provider resulted in confusion in terms of a case of existing code requirements as to the maximum height of a cellular or wireless tower in a P-1 zone; and WHEREAS, the City desires to clarify its code and establish zoning for the location of such towers in a P-1 zone; and WHEREAS, clarification is necessary to protect public, health, safety, and welfare; and WHEREAS, clarification is necessary to provide compatibility with adjacent land uses and conform with the Comprehensive Plan; and WHEREAS, this action has no adverse environmental effect; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section '1. The moratorium is established for four months from the date of passage of this Ordinance on the issuance of permits for the location of wireless communication and/or cellular towers in a P-1 zone. Section 2. An emergency is declared to exist allowing immediate effect of this Ordinance. Ordinance NO. 5616 December 3, 2001 Page 1 Section 3. The facts constituting an emergency are set forth above. Section 4. A public hearing on this moratorium is set for January 7, 2002 at 7:30 PM in City Council Chambers, City of Auburn, Washington. Section 5. If any provisions of this Ordinance are determined to be invalid or unenforceable for any reason, the remaining provisions shall remain in force and effect. Section 6.
