WHEREAS, Application No. CUP02-0001 dated March 06, 2002 was d' submitted to the City of Auburn, Washington, by Ray Wetmore, Church Business Manager (applicant) and the Church of the Nazarene (owner) for a L� O Conditional Use Permit for administrative offices in the R-3, (Duplex), located at O �1235 29th Street, within the City of Auburn, Washington, hereinafter described below and as identified on Exhibit "A" attached hereto and incorporated in this C -- CD Ordinance by this reference; and G WHEREAS, said request above referenced was referred to the Hearing O N Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on April 16, 2002 at the conclusion of which the Hearing Examiner recommended approval of the application. Ordinance 5662 May 14, 2002 Page 1 WHEREAS, the City Council, on May 6, 2002, considered said request and affirmed the Hearing Examiner's decision for the issuance of a Conditional Use Permit to allow a professional office on property located at 1235 29th Street SE zoned R-3 (Duplex) within the City of Auburn, Washington, based upon the following Findings of Fact and Conclusions of Law and Decision, to -wit: FINDINGS OF FACT 1. The Auburn Church of the Nazarene, which is located at 1225 - 29th Street SE, has purchased the adjacent property to the east of the Church. There is currently a 4-plex multi -family structure on the adjacent property. The d- Church of the Nazarene plans to convert the 4-plex to administrative offices, which will be used by the Church itself. Q 2. The zoning of the existing church facility and of the property that contains C) the 4-plex is R-3, Duplex. The R-3 zone at Section 18.16.030(K) allows for C) religious institutions if the City of Auburn approves a conditional use permit. l0 The R-3 zone also allows for professional offices if a conditional use permit �- is approved. cl- C) 3. The property is about 25,000 square feet in area. The 4-plex sits on the CN; first 115 feet of the lot. The remaining rear portion (185 feet) is not G occupied. The Church does not have any plans at this point for the vacant C) rear part of the lot other than to fill a rather large hole that now exists. Any C`li future church related use of the site, other than what is being approved as part of this conditional use permit for the 4-plex, would again require another conditional use permit. 4. Parking for the 4-plex is being provided by a covered parking area on the east side of the 4-plex. Access to the parking area is provided by a shared access easement. The shared access easement also provides access to a multi -family project on the east side of the 4-plex. Conversion of the 4-plex to offices should not have an impact on that access. The number of parking spaces should not be an issue as well. In addition to the existing Ordinance 5662 May 14, 2002 Page 2 parking spaces for the 4-plex, the parking lot for the church is adjacent and can be used as well. It is anticipated that the church offices will not be in use at the same time as a church service. 5. This conditional use permit only allows for the 4-plex to be used as administrative offices for the church. The actual physical conversion will require a building permit and maybe other related permits to be issued by the city. 6. The contents of the case file, CUP02-0001, of this project are hereby incorporated by reference and made part of the record of this hearing. CONCLUSIONS OF LAW ":I- The undersigned has concluded that the conditional use permit may be approved in that it is consistent with the following criteria necessary to grant the O permit as outlined in Section 18.64.040 of the Zoning Ordinance. 0 1. The use will have no more adverse effect on the health, safety or comfort of C:) persons living or working in the area, and will be no more injurious, economically or otherwise, to property or improvements in the surrounding area, than would any use generally permitted in the district. O The conversion of the 4-plex to administrative offices for the Church of the CN Nazarene will likely have a lesser effect on the neighborhood. Traffic, noise Q and other related issues should be less. Q CV 2. The proposal is in accordance with the goals, policies and objectives of the Comprehensive Plan. On page 14-5 of the Comprehensive Plan it states that quasi -public uses such as schools and churches are compatible uses for the R-3 zoned areas. 3. The proposal complies with all requirements of the Zoning Ordinance. The proposal either complies or is capable of complying with requirements of the Zoning Ordinance. The proposal can be constructed and maintained so as to be harmonious and appropriate in design, character, and appearance with the existing or intended character of the general vicinity. There is no indication that the conversion of the 4-plex will be significantly altered from its existing character. 5. The proposal will not adversely affect the public infrastructure. There is no indication that the public infrastructure will be adversely affected. DECISION For each of the above reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this conditional use permit application is approval, subject to the following conditions: O 1. A building permit and other permits as required must be secured prior to the CD conversion of the 4-plex to office use. Permits will also be required for filling Q the hole in the rear of the property. r-- 2. A lot line adjustment is required to combine the lot that has the 4-plex with D_" the lot that has the existing church. The lot line adjustment must be O approved and recorded prior to the occupancy of the 4-plex as an office C``~ use. Q O Cti NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS Section 1. Purpose. The above-cited Hearing Examiner's Findings of Fact and Conclusions of Law and Decision, are herewith incorporated in this Ordinance. Ordinance 5662 May 14, 2002 Page 4 Section 2. A Conditional Use Permit is hereby approved to allow for a administrative offices on property zoned R-3 (Duplex) located at 1235 29th Street SE and identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference in the City of Auburn, County of King, State of Washington. Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other © persons or circumstances. O Section 4. Recording. U the O g. pon passage, a pproval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor.
