HomeMy WebLinkAbout5666 ORDINANCE NO. 5 6 6 6 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON AMENDING SUBSECTION 18.26.020(JJ) OF THE AUBURN CITY CODE RELATING TO "APARTMENTS" AND SUBSECTION 18.26.040(E) OF THE AUBURN CITY CODE ADDRESSING THE MAXIMUM HEIGHT OF BUILDINGS. WHEREAS, Chapter 35A.63 entitled "Planning and Zoning in Code Cities" and RCW 35A.63.100 entitled "Municipal Authority" provides authority to the municipal legislative authority to implement those actions it deems appropriate to provide for a zoning ordinance and amendments thereto; WHEREAS, the City desires to amend the Auburn City Code related to "Zoning", specifically Chapter 18.26 "C-1 Light Commercial District", on matters pertaining to requirements for apartments as a permitted use and standards related to building height; and WHEREAS, thereafter the Auburn City Planning Commission made certain revisions and then recommended approval of the zoning code text amendments to the City Council; and WHEREAS, on May 20, 2002 the Auburn City Council approved amendments to Chapter 18.26 and directed staff to prepare an implementing ordinance; and WHEREAS, SEPA review has been prepared on the proposal and this ordinance does not have an adverse environmental effect. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DO ORDAIN as Follows: Section 1. Purpose That subsection 18.26.020(JJ) of the Auburn City Code be, and the same hereby is, amended to read as follows: 18.26.020 Permitted uses. .1.1. Apartments, within the North Auburn Business Area as established by Resolution 2283, provided they are located in a multistory building and at Ordinance 5666 May 29, 2002 Page 1 least 50% of the gross floor area of the ground floor must contain a permitted use or combination of uses, other than parking, as listed in this Section (18.26.020). The remaining 50% (or portion thereof) of the ground floor may be apartments, conditionally permitted uses, lobby area, recreation, or other uses needed to maintain the building. There are no minimum lot area per dwelling unit density calculations to apply to determine the maximum number of dwelling units allowed; Rather, density shall be limited by the application of other required development regulations to the proposal including, but not limited to, off street parking, setbacks, and landscaping. Section 2. That Subsection 18.26.040(E) of the Auburn City Code be, and the same is, amended to read as follows: 18.26.040 Development Standards. E. Maximum building height: 45 feet. Buildings, within the Auburn North Business Area as established by Resolution 2283, may exceed 45 feet, if one additional foot of setback is provided from each property line for each foot the building exceeds 45 feet in height. Section 3, Severability.. If any portion of this Ordinance or its application to any person or circumstances is held invalid, the remainder of the Ordinance or the application of the provision to other person or circumstances shall not be affected. Section 4, Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as provided by law.
