HomeMy WebLinkAbout5698ORDINANCE NO. 5 6 9 8 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, TO AMEND ORDINANCE NUMBER 5630, WHICH APPROPRIATED COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS FOR 2002 TO ALLOW FOR THE ADDITION OF TWENTY-FIVE THOUSAND DOLLARS ($25,000) IN REALLOCATED FUNDS FROM PRIOR YEARS; AND TO APPROPRIATE A TOTAL AMOUNT OF FOUR HUNDRED THIRTEEN THOUSAND TWO HUNDRED DOLLARS ($413,200) FOR THE 2003 PROGRAM YEAR; AND TO AUTHORIZE THE MAYOR TO IMPLEMENT THE APPROVED PROGRAMS AND PROJECTS. WHEREAS, the City Council of the City of Auburn must adopt and approve all appropriations by ordinance pursuant to Chapter 35A RCW; and WHEREAS, the City is an entitlement recipient for Community Development Block Grant (CDBG) funds under the Housing and Community Development Act of 1974 (the Act), Pub. L. 93-383 as amended, and will receive CDBG funds for the purpose of carrying out eligible community development and housing activities under the Act and under regulations promulgated by the Department of Housing and Urban Development (HUD) at 24 CFR Part 570; and WHEREAS, according to RCW 35A.33.150 special fund appropriations do not lapse but carry forward from year to year until fully expended or the purpose has been accomplished or abandoned without necessity of reappropriation; and Ordinance 5698 October 1,2002 Page 1 WHEREAS, it is in the best interest of the City of Auburn and its citizens to reallocate unused funds in the amount of Thirty-Three Thousand Two Hundred dollars ($33,200) which have accrued and carried forward from previous years, and to reappropriate those funds for the 2002 and 2003 Program Years in order to address current needs; and WHEREAS, it is in the best interest of the City of Auburn and its citizens to set forth a contingency plan to take into consideration the possibility of changes in the anticipated CDBG entitlement amount; and WHEREAS, the City desires to award certain funds for use as described within this Ordinance, for the purpose of implementing eligible activities under the Act and HUD regulations; and WHEREAS, the Legislature has declared that carrying out the purposes of federal grants or programs is both a public purpose and an appropriate function for a city, town, county, or public corporation; NOW THEREFORE THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO HEREBY ORDAIN THE FOLLOWING: SECTION 1. Amendment to Ordinance No. 5630, which appropriated funds for the 2002 program year, to reallocate accrued CDBG funds from prior years in the amount of twenty-five thousand dollars ($25,000). Ordinance No. 5630, approved by the Auburn City Council on February 4, 2002, is hereby amended to reallocate $25,000 in accrued CDBG funds for use in the 2002 Housing Repair Program, as Ordinance 5698 October 1, 2002 Page 2 provided for in "Exhibit A," which was incorporated by reference into Ordinance No. 5630. "Exhibit A" of Ordinance No. ~5630 provides: NEIGHBORHOOD REVITALIZATION City of Auburn's Housin.q. Repair Pro.qram. v,~ ._..,w0°~ nn $150,000 Grants of less than $4,000 and/or loans of less than $10,000 for necessary repairs and renovation of single family homes owned and occupied by Iow and moderate income households at various locations throughout Auburn. {CDBG eligible under 24CFR570.202} SECTION 2. CDBG Budget for 2003 Program Year. The City Council of the City of Auburn hereby approves the reappropriation of accrued CDBG funds from prior years in the amount of eight thousand two hundred dollars ($8,200) and combines this amount into the City of Auburn's 2003 CDBG entitlement of Four Hundred Five Thousand Dollars ($405,000), for a combined 2003 CDBG program budget of Four Hundred Thirteen Thousand Two Hundred Dollars ($413,200) for programs, projects, and administrative costs recommended by the Human Services Committee and approved by the Planning and Community Development Committee for the 2003 CDBG Program Year. Specific expenditures for the 2003 Program Year are itemized in Exhibit "A," attached hereto and incorporated herein by this reference. Disbursement of CDBG funds for a specific program or project Ordinance 5698 October 1, 2002 Page 3 shall not exceed the amount appropriated, as indicated on the itemized budget set forth in Exhibit "A," to this Ordinance No. 5698 for that particular program or project. SECTION 3. Prerequisites for Use of CDBG Funds. Grant recipients must certify that their planned use of CDBG funds complies with the following: (a) Compliance with national obiectives. Grant recipients must certify that their use of CDBG funds gives maximum feasible priority to activities that benefit Iow and moderate income residents or aid in the prevention or elimination of sums or blight. (b) Compliance with environmental review procedures. Grant recipients must certify their compliance with environmental review procedures set forth in 24 CFR, part 58, for each activity as applicable. SECTION 4. Contin,qency Plan. No appropriation shall be made in excess of actual revenues and no liability is to be incurred in excess of appropriations. In the event that actual revenues are different than the revenues estimated by the CDBG budget, the following actions shall be taken: (a) Public Service Proqrams: Ordinance 5698 October 1,2002 Page 4 Ordinance 5698 October 1,2002 Page 5 In the event the City receives a lesser amount of funding than its budgeted CDBG entitlement, each appropriation for public services will receive a proportionately equal reduction in its appropriation relative to the total decrease in total revenues. In the case of an increase in available funding, the final award will be calculated based on the increase in funds available subject to the CDBG 15% Public Services Cap. Of that increase, 70% of the funds shall be awarded to Catholic Community Services-Emergency Assistance, and 30% of the funds shall be awarded to Community Health Centers of King County. (b) Capital-Funds Pro,qrams: Appropriations for capital projects, including the Housing Repair Program, shall be released only when actual revenues are sufficient to fully fund the appropriation unless both the recipient Agency and the City mutually agree to a partial funding of the Agency's original appropriation. Partial funding of an appropriation will release the City from further obligations to fund that particular appropriation and, thereby, allow the City to consider funding either all or part of another appropriation. In the event that the City receives more than its budgeted CDBG entitlement, the non-budgeted portion of the appropriation not available for public service activities will be allocated, in order, as follows. 1. 2. 3. 4. Increase Auburn Housing Repair up to $150,000 Increase Children's Therapy Center to $50,000 Increase Parkview Homes to $40,000 Divide the remaining available funds 65% to Low Income Housing Institute/JC Penney and 35% to the Green River Community College Small Business Assistance Center Funds budgeted to capital projects which are reduced in cost, thus returning funds to the CDBG program during the Program Year, will be reallocated to the Housing Repair Program. SECTION 5. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. SECTION 6. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to Ordinance 5698 October 1,2002 Page 6 any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. SECTION 7. Effective Date: This Ordinance shall be in force and take effect five (5) days from and after its passage, approval and publication, as provided by law. ATTEST: Dan"relle E.
