HomeMy WebLinkAbout5712ORDINANCE NO. 5 7 1 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CITY CODE 13.06.360 PERTAINING TO AUBURN WATER RATES WHEREAS, it has long been the law in the State of Washington that municipalities are entitled to and responsible for controlling the finances of enterprise utilities. See Rands v. Clarke County, 79 Wash. 152,139 Pac. 1090 (1914); and, WHEREAS, it has also been the long-standing practice of the City of Auburn to make sure that its enterprise operations, which include its water utility, charges a sufficient fee to cover the costs of such service; and, WHEREAS, consistent with the above, the provisions of 13.06.065 of the Auburn City Code provide that the water rates to be paid by a consumer receiving service from the City's water utility shall cover the total costs of the water services; and, WHEREAS, in order to assure that the City's water utility fees are sufficient to cover the City's costs of providing such services, it is appropriate to adjust the rates accordingly. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: SECTION ONE. PURPOSE The purpose of this amendment is to incorporate a change in the rate for water service outside the city limits, and insert the "take or pay" rates for 2003 pursuant to the contract approved by Resolution No. 3482. SECTION TWO. City of Auburn utility taxes are included in the monthly rate for all customers except wholesale accounts. Wholesale rates exclude the 37 percent out of city service charge and state excise taxes. That if any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid, the remainder of such code, ordinance or regulation of the application thereof to other person or circumstances shall not be affected. SECTION FOUR. IMPLEMENTATION. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. SECTION FIVE. EFFECTIVE DATE. That this Ordinance shall be in full force and effective five (5) days after publication of the Ordinance Summary.
