HomeMy WebLinkAbout5713ORDINANCE NO. 5 7 1 3 AN ORDINANCE OF THE CiTY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CITY CODE 13.20.440 PERTAINING TO AUBURN SEWER RATES WHEREAS, it has long been the law in the State of Washington that municipalities are entitled to and responsible for controlling the finances of enterprise utilities. See Rands v. Clarke County, 79 Wash. 152, 139 Pac. 1090 (1914); and, WHEREAS, it has also been the long-standing practice of the City of Auburn to make sure that its enterprise operations, which include its sewer utility, charges a sufficient fee to cover the costs of such service; and, WHEREAS, consistent with the above, the provisions of 13.20.440 of the Auburn City Code indicate that the sewer rates to be paid by customers receiving sewer service from the sewer utility of the City shall be charged sufficient fees to cover the costs of such sewer services; and, WHEREAS, in order to assure that the City's sewer utility fees are sufficient to cover the City's costs of providing such services, it is appropriate to adjust the rates accordingly. THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION ONE. PURPOSE The purpose of this amendment is to incorporate a change in the rate for sewer service outside the city limits. SECTION TWO. AMEMDMENT TO SEWER RATES That Section 13.20.440, of the Auburn City Code, relating to the City's sewer rates, is amended to read as follows: 13.20.440 Fees and charges. A. Sewer Rates. The monthly sewer charge to city of Auburn sanitary sewer customers consists of two separate fees. Auburn sanitary sewer utility imposes a charge to maintain, expand and operate the utility's sewer conveyance facilities, and King County imposes a separate fee for the service King County provides. No charge shall be imposed by the city on the amount charged by King County, which amount the city shall pass directly onto the customer as the cost of the service that King County is providing. Ordinance No. 5713 November 15, 2002 Page 1 of 5 Effective January 1, 2000, the monthly sewer rates for Auburn residents will be as follows: Single-family residential rate inside city limits per month $28.00 King County monthly rate $19.50 City of Auburn monthly rate $8.50 Single-family residential rate outside city limits per month $31.15 King County monthly rate $19.50 City of Auburn monthly rate $11.65 Nonsingle-family residential rate inside city limits per month for the first 750 cubic feet of water used each month King County monthly rate City of Auburn monthly rate Plus for each additional 100 cubic feet thereafter King County monthly rate City of Auburn monthly rate $28.00 $19.50 $8.50 $3.45 $2.6O $0.85 Nonsingle-family residential outside city limits per month for the first 750 cubic feet of water used each month King County monthly rate City of Auburn monthly rate Plus for each additional 100 cubic feet thereafter King County monthly rate City of Auburn monthly rate $31.15 $19.50 $11.65 $3.76 $2.60 $1.16 Effective January 1, 2001, Auburn's portion of the monthly sewer rates shall be as follows (King County's rates have not yet been established, but will be passed on directly to the customer): Single-family residential rate inside city limits per month: City of Auburn monthly rate $8.75 Single-family residential rate outside city limits per month: City of Auburn monthly rate $11.99 Nonsingle-family residential rate inside city limits per month for the first 750 cubic feet of water used each month: City of Auburn monthly rate $8.75 Plus for each additional 100 cubic feet ther.eafter: Ordinance No. 5713 November 15, 2002 Page 2 of 5 City of Auburn monthly rate $0.88 Nonsingle-family residential outside city limits per month for the first 750 cubic feet of water used each month: City of Auburn monthly rate $11.99 Plus for each additional 100 cubic feet thereafter: City of Auburn monthly rate $1.21 Effective January 1, 2002, Auburn's portion of the monthly sewer rates shall be as follows (King County's rates have not yet been established, but will be passed on directly to the customer): Single-family residential rate inside city limits per month: City of Auburn monthly rate $9.00 Single-family residential rate outside city limits per month: City of Auburn monthly rate $12.33 Nonsingle-family residential rate inside city limits per month for the first 750 cubic feet of water used each month: City of Auburn monthly rate $9.00 Plus for each additional 100 cubic feet thereafter: City of Auburn monthly rate $0.90 Nonsingle-family residential rate outside city limits per month for the first 750 cubic feet of water used each month: City of Auburn monthly rate $12.33 Plus for each additional 100 cubic feet thereafter: City of Auburn monthly rate $1.23 Effective as of the first full billing cycle after January 1, 2003, Auburn's portion of the monthly sewer rates shall be as follows (King County's rates have not yet been established, but will be passed on directly to the customer): Single-family residential rate inside city limits per month: City of Auburn monthly rate $9.25 Single-family residential rate outside city limits per month: City of Auburn monthly rate $! 2.5713.87 Nonsingle-family residential rate inside city limits per month for the first 750 cubic feet of water used each month: City of Auburn monthly rate $9.25 Plus for each additional 100 cubic feet thereafter: Ordinance No. 5713 November 15, 2002 Page 3 of 5 City of Auburn monthly rate $0.93 Nonsingle-family residential rate outside city limits per month for the first 750 cubic feet of water used each month: City of Auburn monthly rate $! 2.6713.87 Plus for each additional 100 cubic feet thereafter: City of Auburn monthly rate $1.271.39 The rates beginning the first full billing cycle after January 1, 2003 reflect a 50 percent surcharqe for single-family and nonsin.qle-family residential rates outside city limits. Nonsingle-family accounts will be allowed to average winter water consumption for the billing dates falling between December through May to determine the summer sewer rates for the billing dates failing between July and October. Said allowance shall be upon application and with appropriate justification that additional summer usage does not enter the sewer system. The months of November through June shall be billed per water used, at the rates noted above. Nonsingle-family accounts without city water service shall be charged at the rate as noted above for inside-the-city or outside-the-city nonsingle family customers. The customer shall have installed an approved city water meter or other acceptable means of recording water use, by applying for a permit under ACC 13.04.110, which shall be read by the water department to determine sewage charges on nonsingle-family private water systems. B. Permit Fees. Permits for side sewer repair, replacement, inspection, or tapping side sewers will require a nonrefundable deposit of $50.00. The deposit shall be paid to the director of finance at the time an application is filed. The permit application shall be reviewed and a permit fee shall be estimated based upon the required materials, staff time and current labor rates effective in accordance with Chapter 3.18 ACC, Reimbursable Labor Rates. The estimated permit fee shall be credited with the deposit and the remaining fee shall be paid to the director of finance prior to issuing the permit. SECTION THREE. GENERAL SEVERABILITY. That if any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid, the remainder of such code, ordinance or regulation of the application thereof to other person or circumstances shall not be affected. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. SECTION FIVE. EFFECTIVE DATE. That this Ordinance shall be publication of the Ordinance Summary.
