AN ORDINANCE of the City Council of the City of Auburn,
Washington, amending Section 8.08.180 of the Auburn City
Code, and authorizing the Mayor and City Clerk of the City of
Auburn to enter into Amendment I to the "Comprehensive
Garbage, Recyclables and Yard Debris Collection Contract'
between the City of Auburn and Waste Management of
Washington, Inc. (d/b/a RST Disposal), relating to additional
solid waste services, the fees and charges therefore and
certain clarifications relative thereto
WHEREAS, the City of Auburn conducted a competitive process to determine a
contractor to provide garbage, recyclables and yard debris collection services to city
residents, businesses, and institutions; and
WHEREAS, the contract for services outlined in the competitive process was
awarded to Waste Management of Washington, Inc., (d/b/a RST Disposal) on July 16,
2001, pursuant to Resolution No. 3362; and
WHEREAS, the "Comprehensive Garbage, Recyclables and Yard Debris
Collection Contract' was amended on December 2, 2002, to add a new Section 2.2.7.4
entitled "Special Pickups," to amend Section 2.2.8 to clarify charges, to amend
Attachment B to clarify service fees for 'Temporary Container Service," to provide
additional services and charges therefor, and to amend the 'Table of Contents' to
reflect the amendments; and,
WHEREAS, it has been determined that the solid waste provisions in the Auburn
City Code Chapter 8.08 entitled "Solid Waste" must be amended in order to implement
new and additional services and the charges therefor that are provided pursuant to
Amendment I to the "Comprehensive Garbage, Recyclables and Yard Debris Collection
Contract." In addition, new provisions are provided for multi -unit residential accounts,

for a deposit charge for 40 cubic yard containers and for clarification of return trip
charges; and
WHEREAS, the City Council published rates in the South County Journal on
November 22 and 29, 2002, and conducted a public hearing on December 2, 2002, for
the purpose of receiving public comments with regard to rate changes for solid waste
collection services; and,
WHEREAS, it is therefore appropriate to amend the provisions of the Auburn City
Code consistent with and in conjunction with the approval of the Contract Amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. The purpose of this ordinance is to amend the appropriate
provisions of Chapter 8.08 of the Auburn City Code (ACC), entitled "Solid Waste," for
purposes of implementing additional solid waste services and charges therefore, and
adding new provisions to Chapter 8.08 for multi -unit residential accounts, for a deposit
charge for 40 cubic yard containers and for clarification of return trip charges, and
clarifying certain charges as provided pursuant to Amendment I to the "Comprehensive
Garbage, Recyclables and Yard Debris Collection Contract."
Section 2. Amend City Code Section. Section 8.08.180 of the Auburn City
Code is amended to read as follows:
8.08.180 Collection charges — Residential and commercial collections.
A. Services and charges herein shall become effective for each account on
January 1, 2002. Upon this date, services shall be provided at the 32 -gallon can service
rate unless the finance department is notified otherwise by the tenant or property owner.
Likewise, unless the finance department is otherwise notified, services will automatically
revert to the 32 -gallon can service rate upon a change in property tenancy or
ownership. Rates to be charged by the city for solid waste services shall be as follows:

B. Multi -unit residential accounts must have the same type of service for each
'occupied unit', unless tenant and owner sign City tenant release form for single-family
residence garbage service. Tenant then pays direct to the City for solid waste services
and is provided variable solid waste service as defined in "single family residence
esse..ad-mit-Owners are responsible for payment if tenant does not pay. If no

C. Garbage collections in excess of those included in the current monthly service
(as listed on the account) shall be at the rate of $9.42 per extra 32 gallons (by volume)
per pickup.
D. For temporary and roll off services, services and charges herein shall become
effective on January 1, 2002, and do not include tipping fees charged by the King
County solid waste division which shall be added to the total service charges. Minimum
charges for temporary and roll off services include applicable delivery and pickup fees
and rental rates per month. Temporary and roll off service rates (not including tipping
fees) shall be as follows:

E. Rental rates for dumpsters and drop boxes are required with the provision that
persons, firms or corporations may furnish their own detachable bulk containers on
approval of the solid waste administrator. These containers shall be constructed so that
they can be readily picked up by the service provider and the service provider's
equipment.
F. A deposit for all temporary containers 20 cubic yards or larger is required prior
to delivery. These charges are as follows:

As other temporary containers become available, a deposit shall be required for
the use of such container and the deposit amount shall be based on size. The amount

Section 3. Approval of Contract Amendment. The Mayor and City Clerk of the
City of Auburn, Washington, are herewith authorized and directed to enter into
Amendment I to the "Comprehensive Garbage, Recyclables and Yard Debris Collection
Contract' entered into between the City of Auburn and Waste Management of
Washington, Inc., (d/b/a RST Disposal) for the purpose of adding additional rates for
additional services that have been identified as necessary for garbage, recyclables and
yard debris collection services and clarifying the rate heading for temporary container

services. A copy of said Amendment I is attached hereto and denominated as Exhibit
"A" and made a part hereof as though fully set forth.
Section 4. Implementation. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 5. Constitutionality or Invalidity. If any section, subsection, clause,
phrase or sentence of this Ordinance, is for any reason held to be invalid or
unconstitutional, such invalidity or unconstitutionality of the remaining portions of this
ordinance, as it is being hereby expressly declared that this ordinance and each
section, subsection, clause, phrase, or sentence, hereof would have been prepared,
proposed, adopted and approved and ratified irrespective of the fact that any one or
more section, subsection, clause, phrase, or sentence, be declared invalid or
unconstitutional.
Section 6. The Mayor is hereby authorized to implement such administrative
procedures as may be necessary to carry out the directions of this legislation.
Section 7. Effective Date. This ordinance shall take effect and be in force on
January 3, 2003, provided that the Contract Amendment approved hereby shall take
effect as indicated therein.

AMENDMENT I
TO COMPREHENSIVE GARBAGE, RECYCLABLES AND YARD DEBRIS
COLLECTION CONTRACT entered into between the City of Auburn and Waste
Management of Washington, Inc. (dba RST Disposal) July 16, 2002 for the time
period January 1, 2002 - December 31, 2008
This Amendment I is entered into pursuant to Section 6.14 of the "Comprehensive
Garbage, Recyclables and Yard Debris Collection Contract" by and between the CITY
OF AUBURN, a municipal corporation of the State of Washington, whose address is 25
West Main Street, Auburn, Washington 98001, hereinafter referred to as "CITY" and
WASTE MANAGEMENT OF WASHINGTON, INC. (dba RST Disposal), hereinafter
referred to as "CONTRACTOR".
NOW, THEREFORE, in consideration of the covenants and conditions of this
Addendum I to the Comprehensive Garbage, Recyclables and Yard Debris Collection
Contract, the CITY and CONTRACTOR agree as follows:
A. PURPOSE:
It is the purpose of this Addendum I to reflect the CITY'S needs by adding additional
rates for additional services that have been identified as necessary for garbage,
recyclables and yard debris collection services.
B. AMENDMENTS
1. New Section. There is added a new section 2.2.7.4 as follows on page 26
of both the present contract and Amendment I:
Section 2.2.7.4 Special Pickups
The contractor shall Provide special pickup service to customers requesting additional
pickups in excess of scheduled services. The contractor shall Provide special pickup
garbage services for one to six cubic yard non -compacted containers within 24 hours of
the original call. The charges for special pickup service shall include collection and
disposal as listed in Attachment B.
The new section is attached hereto as Exhibit "1" and fully incorporated herein by
this reference.

2. Amended Section. Section 2.2.8 is amended as follows and appears on
page 26 of the present contract and moves to page 27 of the amended contract:
The Contractor shall provide temporary two, four and six cubic yard Detachable
Containers to Residential and Commercial Customers on an on-call basis. The per
ip ckuu charges for temporary container service shall include delivery, collection and
disposal as listed in Attachment B. Rental charges for temporary containers shall be
charged in addition to the basic temporary container fee, at the rates listed in Attachment
B.
The amended Section 2.2.8 is attached hereto as Exhibit "2" and fully
incorporated herein by this reference.
Amended Attachment B. Attachment B is amended as follows:
(a) On page 1 of the present Attachment B, a heading has been added as
shown in amended Attachment B, attached hereto, marked as Exhibit "3" and fully
incorporated herein by this reference, at the line on which the section entitled
"Temporary Container Service" appears in order to clarify that service fees are assessed
on a "Per Pickup" basis. The new language added is "Per Pickup." This amendment
appears on page 1 of Exhibit "3".
(b) On page 3 of the present Attachment B, under the section entitled
"Compacted Containers," additional rates for additional services have been added as
shown in amended Attachment B for the 1 through 5 Cubic Yard Container categories.
This amendment appears on page 2 of Exhibit "3".
(c) A new service is added to the section entitled "Compacted Containers" as
shown in amended Attachment B providing for a "6 Cubic Yard Container" together with
charges for the "pickups". This amendment appears on page 2 of Exhibit 113".
(d) A new section entitled "Special pickup" for "non -compacted containers"
for 1 through 6 Cubic Yard Containers has been added as shown in the amended
Attachment B. This amendment appears on page 3 of Exhibit "3".
4. Amended "Table of Contents". The "Table of Contents" is amended on
page ii to add a new Section 2.2.74 entitled "Special Pickups" together with appropriate
amendments to page numbers.
The amended "Table of Contents" is attached hereto as Exhibit "4" and is fully
incorporated herein by this reference.

5. Effective Date.
The effective date of the provision s contained in this Amendment I is January 1, 2003.
6. Remaining Provisions.
All of the remaining provisions contained in the "Comprehensive Garbage, Recyclables
and Yard Debris Collection Contract' entered into between the City of Auburn and
Waste Management of Washington, Inc. (dba RST Disposal) for the time period January
1, 2002 - December 31, 2008 approved by the Auburn City Council on July 16, 2001
remain in full force and effect during the term of the contract.

2.2.7 Drop -Box Container Garbage Collection
2.2.7.1 Subject Materials
The Contractor shall transport and dispose of Drop -box Container contents through the King
County Disposal System,
The Contractor shall not be required to collect Drop -box Containers containing hazardous
materials that are either restricted from disposal or would pose a danger to collection crews. If
materials are rejected for this reason, the Contractor shall leave a notice with the rejected
materials listing why they were not collected and providing the customer with a contact for
further information on proper disposal. If a Drop -box Container customer persistently includes
inappropriate materials in their containers, the Contractor shall photograph the inappropriate
materials, and provide the customer's name and address to the City for further action.
2.2.7.2 Containers
The Contractor shall provide containers meeting the standards described in Section 2.1.15. Both
customer -owned and Contractor -owned Drop -box Containers shall be serviced, including
customer -owned compactors.
Contractor -owned containers shall be delivered by the Contractor to requesting customers
within seven days of the customer's initial request.
2.2.7.3 Specific Collection Requirements
Residential and commercial Drop -box Container collection must occur during the hours and
days specified in Section 2.1.4. Collection of Drop -box Containers in Residential areas shall be
limited to the same hours as Single Family Residential collection. The Contractor shall place
and collect Drop -Box Containers in areas accessed through alleys where possible.
The Contractor shall provide dispatch service and equipment capability to collect full Drop -box
Containers no later than the next business day after the customer's initial call. The Contractor
shall maintain a sufficient Drop -box Container inventory to provide empty containers to new
and temporary customers within three business days after the customer's initial call.
2.2.7.4 Special Pickups
The contractor shall providespecial pickup service to customers requesting additional pickups
in excess of scheduled services. The contractor shall providespecial pickup garbage services
for one to six cubic yard non -compacted containers within 24 hours of the original call The
charges for special pickup service shall include collection and disposal as listed in Attachment
B.

Solid Waste Collection Contract
2.2.8 Temporary Customers
The Contractor shall provide temporary two, four and six cubic yard Detachable Containers to
Residential and Commercial Customers on an on-call basis. The per pickup charges for
temporary container service shall include delivery, collection and disposal as listed in
Attachment B. Rental charges for temporary containers shall be charged in addition to the
basic temporary container fee, at the rates listed in Attachment B.
Temporary containers shall be delivered by the Contractor to customers within seven days of
the customer's initial request.
2.2.9 Services to the Boeing Company
The Contractor shall adapt one or more of its collection vehicles to collect the Boeing
Company's specialized Detachable Containers ("stackable tubskids ") used to contain Garbage
at Boeing Company facilities within the City Service Area.
The Contractor shall provide daily collection Monday through Friday on an on-call basis at the
request of the Boeing Company. The Contractor shall service the specialized Detachable
Containers and Drop -Boxes within 24 hours of the Boeing Company's request, and shall
comply with Boeing Company facility access requirements and gate receipt requirements,
including the noting of entry and exit times on Boeing Company -provided haul slips.
Collected Garbage shall be disposed through King County Disposal System.
There shall be two adjustable weekday (Monday through Friday) collection time windows
mutually agreed upon by the Contractor and the Boeing Company tentatively set at 9:00 a.m. to
1:00 p.m. and again from 5:00 p.m. to 9:00 p.m. to empty the specialized Detachable Containers
into the Contractor's collection vehicle. On Saturday and Sunday, there shall be one adjustable
window, mutually agreed upon by the Contractor and the Boeing Company tentatively set at
12:00 noon to 3:00 p.m. to dump the specialized Detachable Containers.
The Boeing Company will ensure that the specialized Detachable Container staging areas
provide adequate space and turning radius for the Contractors drivers to safely maneuver
collection vehicles. The Contractor shall make the necessary number of trips to ensure that the
specialized Detachable Containers located within each staging area are collected during each
specified time window
The Boeing Company will be responsible for the purchase, maintenance and repair of
company-owned specialized Detachable Containers. The Contractor will notify the designated
Boeing Company representative of needed repairs noted during collections.
