HomeMy WebLinkAbout5778ORDINANCE NO. 5778 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 2.03.070 AND 3.10.020 OF THE AUBURN CITY CODE, REGARDING AUTHORITY OF THE MAYOR WHEREAS, the provisions of the Auburn City Code (ACC) include language that identifies the authority of the Mayor and other city officials to take certain action and approve expenditures; and WHEREAS, the portions of the ACC delineating mayoral authority, while for the most part are based on legal parameters set forth in state statutes, include some provisions where the underlying statutes accommodate flexibility, and where the City is entitled to exercise discretion; and WHEREAS, the City Code provisions identifying the level of authority for approval of expenditures deserve periodic review and revision, as warranted; and WHEREAS, in reviewing these Code provisions, it is appropriate to adjust them to provide for an appropriate authority level, to meet the on going needs of the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. AMENDMENT. Section 2.03.070 of the Auburn City Code, regarding the power and authority of the Mayor, is amended to read as follows: 2.03.070 Supervisory and administrative .powers. The mayor shall have general supervision over the several departments of the city government and over all its interests. Except as otherwise provided for by ordinance or state law, city administrative officers shall be responsible to the mayor for the efficient and economical conduct of their respective departments and offices. Where necessary he will initiate programs designed to bring work up to proper standards and levels of performance. The mayor shall also have general administrative authority provided by state statutes, city ordinances and as not in conflict with state law. The mayor shall also Ordinance No. 5778 July 7, 2003 Page 1 have authority to approve expenditures in accordance with Section 3.10.020 of the City Code and/or as otherwise provided. (1957 code § 1.03.080.) Section2. AMENDMENT. Section 3.10.020 of the Auburn City Code, regarding the authority to approve expenditures, is amended to read as follows: 3.10.020 Expenditure limits. The following expenditure limits and authorization approvals shall apply for all expenditures of municipal goods and services. For f~Fe,~ases-contracts with total dollar amounts .up to $5,000, authority rests at the department director level. All ~ contracts over $5,000, up to $25,000, and contracts for goods and services that have been individually and separately listed in the city's annual budget shall be approved and signed by the mayor,,.,~,~,,,.~ ......... ,,,,.,~,,,~.,' ..,~.~.,,,.,.,,' prior to purchase order issuance or placement of an order with vendors. For all unbudgeted i~:m~-expenditures not individually and separately listed in the city's annual budget in excess of $25,000, approval shall be obtained from the mayor, the appropriate council committee and the city council. Such committee approval shall be reflected in the committee minutes. (Ord. 5490 § 1, 2000.) Section 3. ADMINISTRATIVE AUTHORITY. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section4. SEVERABILITY. If any provision of this Ordinance or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances shall not be affected. Section 5. EFFECTIVE DATE. This ordinance shall take effect and be in force five (5) days from and after its passage and publication as required by law.
