HomeMy WebLinkAbout5784ORDINANCE NO. 5 7 8 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 12.60.010 AND 12.60.030 OF THE AUBURN CITY CODE, RELATING TO "RIGHT-OF-WAY PERMITS" WHEREAS, a review of the current Right-of-Way Use Permits issuance revealed a need to clarify the Public Works Committee involvement in issuance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That Section 12.60.010 of the City of Auburn Code is amended to read as follows: 12.60.010 Purpose - Issuance - Authority - Requirements. The purpose of regulating right-of-way uses is to assure that proposed uses are consistent with public health, safety, and welfare of the community, and that any harm or nuisance which may result from a proposed use is prevented. Thc '"'~'" ...... ~'" engineer shall establish procedures to administer the permit program. Decisions regarding issuance, renewal, denial, or termination of any such permits shall be subject to insurance requirements, bond requirements, hold harmless agreements, evaluation of competing public interest, and other administrative details determined and administered by the city engineer. Issuance of right-of-way use permits that include community events, long-term use exceedinq 30 days, such as: monitorinq wells, signs, conduit, pipe lines, parking, landscaping, bus shelters, awnings, or uses with policy implications will require public works committee approval. That Section 12.60.030 of the City of Auburn Code is amended to read as follows: 12.60.030 Street banners - When allowed - Permit required. A. The combined application and permit fee for street banners shall be $25.00 and is nonrefundable. The fee shall be paid at the time the application is submitted. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this ordinance. Section 4. If any portion of this Ordinance or its application to any person or circumstances is held invalid, the remainder of the Ordinance or the application of the provision to other persons or circumstances shall not be affected. Section 5. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
