HomeMy WebLinkAbout5793ORDINANCE NO. 5 7 9 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 19.02.120 OF THE AUBURN CITY CODE PERTAINING TO AUBURN SCHOOL DISTRICT IMPACT FEES WHEREAS, the City of Auburn includes provisions that spell out the amounts of area school impact fees; and WHEREAS, the Auburn School District recently re-evaluated its needs, and submitted a request to the City to amend the impact fees for the District; and WHEREAS, after having considered the request and the factors involved therewith, the City Council seeks to amend the impact fee schedule for the Auburn School District, providing for a three-step rate increase. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION ONE. AMENDMENT TO CITY CODE. Auburn City Code is amended to read as follows: That Section 19.02.120 of the 19.02.120 Impact fee calculation and schedule for the Auburn School District. The impact fee calculation and schedule is based upon the impact fee calculation for single-family residences and for multifamily residences set forth in the Auburn School District's Capital Facilities Plan, dated July 1998May 2003. The calculation is the determination of the appropriate proportionate share of the costs of public school capital facilities needed to serve new growth and development to be funded by school impact fees based on the factors defined in ACC 19.02.020. A. Effective January 1, 20041 the school impact fee shall be as follows: Per Single-Family Dwelling Unit · ~ OAQ 7~ Per Multifamily Dwelling Unit Ordinance No. 5793 November 17, 2003 Page 1 of 3 Effective January 1, 2005, the school impact fee shall be the lesser of the following: i. Per Sinqle Family Per Multifamily Dwellinq Unit $~,5oo.oo or Dwelling Unit $1,200.00 Should the net fee obligation identified in the most recent Capital Facilities Plan adopted by the Auburn School District be less than amounts listed in Section B. i. above, then the fee obligation shall be in accordance with the net fee obligation identified in said plan and adopted by reference as part of the capital facilities element of the City of Auburn's Comprehensive Plan. C. Beginning, January 1, 2006, and for every January 1 thereafter the school impact fee shall be in accordance with the net fee obliqation identified in the most recent Capital Facilities Plan adopted by the Auburn School District and adopted by reference as part of the capital facilities element of City of Auburn's comprehensive plan. (Ord. 5232 § 1, 1999.) SECTION TVVO. GENERAL SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or circumstance is held to be invalid, the remainder of such code, ordinance or regulation or the application thereof to other person or circumstances shall not be affected. SECTION THREE. IMPLEMENTATION. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. SECTION FOUR. EFFECTIVE DATE. This Ordinance shall be in full force and effect five (5) days after publication of the Ordinance Summary, and on January 1, 2004, except as otherwise stated.
