AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, REPEALING
CHAPTER 2.69 OF THE AUBURN CITY CODE
RELATING TO THE CITY OF AUBURN LIBRARY
BOARD
WHEREAS, in February, 1997, the citizens of the City of Auburn voted to annex
to the King County Library System, a separate taxing district providing library services;
and
WHEREAS, following the annexation to the King County Library System, the City
Council created a new Auburn City Code Chapter 2.69 entitled "City of Auburn Library
Board" whose powers and duties include promoting library programs and providing input
and making recommendations to the King County Library System Board of Trustees;
and
WHEREAS, the Friends of the Auburn Library is a non-profit group that supports
the library through volunteerism, fund-raising activities and sponsorship of programs
and activities, and performs many of the duties delegated to the Auburn Library Board
thereby diminishing the need for an Auburn Library Board.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. Code Chapter Repealed. Chapter 2.69 of the Auburn City Code is hereby
repealed.

Section 2. Administrative Authority. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 3. Severability. If any provision of this ordinance or its application to any
person or circumstances is held invalid, the remainder of the act of the application of the
provision to other persons or circumstances shall not be affected.
Section 4. Effective date. This ordinance shall take effect and be in force five (5) days
after passage and publication as required by law.

2.69.010 Definitions.
As used in this chapter, unless the context requires a different meaning:
A. "Library" or "libraries" means the public library or libraries in the city.
B. "Board" means the library commissioners.
C. "Trustees" means the board of trustees of the King County Library System
or other contracted governmental unit. (Ord. 5599 S 1, 2001.)
2.69.020 Creation.
In February, 1997, citizens of Auburn voted to annex to the King County Library
System (KCLS), a separate taxing district, providing library services for citizens. (Ord.
5599 S 1, 2001.)
2.69.030 Created - Membership.
There is created a board of library commissioners, consisting of seven members,
who shall be appointed by the mayor with consent of the city council from citizens of
recognized fitness for such position. No commissioner shall receive any compensation
for service. (Ord. 5599 S 1, 2001.)
2.69.040 Board of commissioners - Terms.
The five library commissioners presently serving shall complete their current
terms of office. The length of service of the additional two commissioners, appointed
under the terms of the ordinance codified in this section, shall be determined by lot as to
whose term will expire in two and four years respectively. Their terms shall begin after
their appointment has been approved by the city council. Terms of office for all
commissioners, at the expiration of their initial term, shall become five-year terms;
provided, that the term of office for any committee members appointed or reappointed
after December 1, 2004, shall be three years from the date of appointment or
reappointment.
No commissioner shall serve more than two consecutive three-year terms. (Ord.

Vacancies in the board shall be filled for the un-expired terms or for new terms as
soon as possible by the mayor with the consent of the city council. (Ord. 5599 S 1,
2001.)
2.69.060 Board of commissioners - Member removal.
Commissioners of the board shall be subject to removal in accordance with the
provisions of Chapter 2.30 ACC as it currently exists or as it may be amended hereafter.

2.69.070 Board of commissioners - Annual report.
At the close of each year the board shall make a report to the city council
showing the state of the library and such other statistics and information and
suggestions as it deems of public interest. (Ord. 5599 S 1, 2001.)
2.69.080 Board of commissioners - Powers and duties.
The commissioners annually, and at such other times as may be necessary, shall
meet for organization by the election of such officers as they deem necessary. They
shall:
A. Adopt such bylaws, rules and regulations for their own guidance as they
deem necessary;
B. Provide input and make recommendations to the trustees regarding the
policies and procedures necessary to best serve the library needs of the community;
C. Promote library programs and policies and advocate for support of the
library;
D. Accept such gifts of money or property for library purposes as they deem
appropriate. (Ord. 5599 S 1, 2001.)
2.69.090 Property destruction - Penalty.
The intentional injury, defacing or destruction of any property belonging to or
deposited in the library is a misdemeanor, punishable in accordance with ACC
1.24.010. (Ord. 5683 S 3, 2002; Ord. 5599 S 1,2001.)
2.69.100 Contract service.
Nothing in this chapter shall prevent the city council from securing library service
from another governmental unit, and in like manner the city council shall have the power
to contract for like service from any library not maintained by a public corporation to the
extent permissible by state law as now existing or hereafter amended. (Ord. 5599 S 1,

2.69.110 Use of money or property.
Any money or property given to or for the use or benefit of the library and vested
in the board of commissioners shall be held and used by the board according to the
terms of the gift, but all money or property given to the board of commissioners for the
use or benefit of the library for which no express purpose has been given other than for
library purposes shall be used for such library purposes as may be deemed appropriate
by the board of library commissioners. (Ord. 5599 S 1, 2001.)
