HomeMy WebLinkAbout6106ORDINANCE NO.6 1 0 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, CREATING A NEW SECTION 10.12.405 OF THE AUBURN CITY CODE RELATING TO PROHIBITING MOTOR VEHICLES FROM AVOIDING AN INTERSECTION WHEREAS, the City Council finds that motorists who avoid controlled intersections by leaving the roadway and driving their vehicles across private or public property present a public safety risk and disrupt the flow of traffic on City streets; and WHEREAS, the City Council wishes to protect the public and to improve the flow of traffic through the City, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. Amendment to City Code. That Chapter 10.12, Traffic Regulations, of the Auburn City Code be and the same hereby is amended by the addition of a new section 10.12.405 to read as follows: 10.12.405 Unlawful avoidance of an intersection. It is unlawful for any person operating a motor vehicle to leave a roadway's marked lanes of travel and proceed across any private property or publicly owned non-right-of-way property for the purpose of avoiding an intersection or traffic-control device controlling an intersection, unless so directed by proper authorities. There shall be a rebuttable presumption that a person operating a motor vehicle that leaves one roadway and enters onto another roadway by crossing private property or publicly owned non-right-of-way property has done so for the purpose of avoiding an intersection where the driver did not stop, significantly change speed, or give other indication of an intent to stop upon said property. Violation of Ordinance 6106 August 2, 2007 Page 1 of 3 this section is a traffic infraction, punishable in accordance with ACC 10.12.050 and ACC 1.25.050. Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
