HomeMy WebLinkAbout6109ORDINANCE NO. 6 1 0 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 10.42.060 OF THE AUBURN CITY CODE RELATING TO AUTOMATED TRAFFIC ENFORCEMENT PENALTIES WHEREAS, the Legislature of the State of Washington has added assessments to the penalty provisions applicable to traffic infractions generally; and WHEREAS, the City Council of the City of Auburn, Washington, established a photo-enforcement program for red-light violations and for speeding in school zones, whereby the violations are treated as and are comparable to parking violations; and WHEREAS, the photo-enforcement penalties were set at rates essentially equivalent to that which a person would have to pay for the same violations if enforced through regular traffic infraction enforcement; and WHEREAS, it is appropriate to adjust the penalties for photo-enforcement violations to maintain that penalty consistency, up to levels permissible under statute. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section I. Amendment to City Code. That Section 10.42.060 of the Auburn City Code shall be amended to read as follows: 10.42.060 Fines. A. Stoplight Violations and Railroad Crossing Violations. The fine for stoplight violation and railroad crossing violation infractions committed pursuant to the provisions of this chapter shall be $~~1-08124.00 if paid within 15 days from the date of issuance of such notice, or in the sum of $-~4-88157.00 if not paid within 15 days from the date of issuance of such notice. Fines shall be paid directly to the Auburn municipal court or as otherwise directed on the notice of Ordinance No. 6109 July 16, 2006 Page 1 infraction. It is further provided that if the fine amounts are not paid before the amounts due are sent to collection, or before the city or a contractor on the city's behalf take action to collect the same, the costs of such collection efforts shall be added to the amounts due and owing. B. School Speed Zone Violations. The fine for school speed zone violation infractions committed pursuant to the provisions of this chapter shall be $x:98200.00 if paid within 15 days from the date of issuance of such notice, or in the sum of $2~:-98250.00 if not paid within 15 days from the date of issuance of such notice. Fines shall be paid directly to the Auburn municipal court or as otherwise directed on the notice of infraction. It is further provided that if the fine amounts are not paid before the amounts due are sent to collection, or before the city or a contractor on the city's behalf take action to collect the same, the costs of such collection efforts shall be added to the amounts due and owing. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Effective date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
