A RESOLUTTON OF THE CITY OF AUBURN, WASHINGTON, AUTHORZZING AND DIRECTING THE MAYOR AND
CITY CLERK TO SIGN, ON BEHALF OF THE CTTY, AN A6REEMENT (AGREEMENT GM 552 SUPPLE-
MENT N0. 1) BETWEEN TF(E GITY OF AUBURN AND THE STATE OF WASHINGTON WHEREBY THE CITY
AGREES TQ ASSUME MATNTENANCE, REPAIR AND RIGHT-OF-WAY FOR CE'RTAIN FRONTAGE SERVICE
ROAD.
THE CTTY COUNCIL OF THE CITY OF AUBURN, WASHTNGTON, DO RESOLVE AS FOLLOWS:
THAT ths Mayor and City Clerk of the City of Auburn, Washington, be and they are
hereby authorjzed and directed to sign, on beha1f of the City, an Agreement (Agreement
GM 552 Supplement No. 1) between the City of Auburn and the State of Washington whereby

the City agrees to assume maintenance, repair and right-of-way for certain frontage
service road, a copy of said Agreement is attached hereto, designated Exhibit °A" and
made a part hereof as though set forth herein in fu11.

and through the Director of Highways, hereinafter referred to as the "STATE" and the .
City of Auburn, hereinafter referred to as the "C1TY".
WITNESSETH:

~ to S . 5 ~ • ~ WHEREAS, the State is ptanning to reconstruct certain roadways and interchanges

with a certain frontage road as a part of the improve.ment of SR 167 located in the
, City of Auburn and more particularly as shown on the attached Right of Way Sheets,
sheets l and 2 of 2.
LIHEREAS, the said frontage Road wi11 be constructed in accordance with ihe Contract
Plans Specifications and detailed drawings therein, within the limits of the above '
. referenced revised Right of Way Plans, ifi is desirable to describe the responsibility of
the State and the City in the maintenance of these roadways. ~
WHEREAS, Subsection 5, Section 11, Chapter 108, Laws of 1967 and RCw 47.52•090(5)
provides that, "The ccnstruction and maintenance of city streets over and under crass;ngs
and surface intersections of the limited access facilities shall be in-eccordance with
the governing policy enterzd into between the State Highway Commiss,.i.on and the Associaticn
of Washington Cities". THEREFQRE, it is mutuaTly agreed that:

The City agrees to per`orm ait maintenance, repair, or reconstruction of the
before mentioned Frontage Road including rights of way, as shown in red on the ptans
marked "EXHIBI? A", attached hereto, and by this reference made a part of this agreement.

7he City agrees to protect the controt of access, as indicafied by the "Hachured
Line" on the above referenced revised Right of 1Jay Plans and on the attached "EXHIBIT A"

between tne State right of way and the Cifiy's Frontage Road, and in.the vicinity of the.
roadway intersections.

The State_agrees to convey to the City by Governor's Deed said Frontage Road in

zccordance with the right of way descriptions as shown on the aforementioned right of

The City agrees to accept this said Frontage Road as hereinbefore described as
city streets and further agrees to relieve the State from atl responsibility in the ;

operation of this roadway as a public thoroughfare upon cornpletion of construction, in ~
conformance with the contract plans, specifications and detailed drawings therein. '

It is provided and agreed tnat no liabitity shalt attach to the,Stete by reason .
of enteri~ng into ttiis agreement except as expressly provided herein.
