A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR
AyD CiTY CLERK TO SIGN, ON BEHALF OF THE CITY, AN AGREEMENT BETWEEN THE STATE
OF WASHINGTON, WASHINGTON STATE HIGHWAY COMMISSION AND THE CITY OF AUBURN PER-
TAINING TO THE CONSTRUCTION OF STATE ROUTE 167, SAID AGREEMENT KNOWN AS
AGREEMENT NO. GM 552 SUPP. N0. 2:
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS:
THAT the Mayor and City Clerk of the City of Auburn, Washington, be and they are
hereby authorized and directed to enter into an agreement between the State of
Washington, Washington State Highway Commission and the City of Auburn pertaining to
the construction of State Route 167, said agreement known as Agreement No. GM 552 Supp.
No. 2, a copy of said agreement is attached hereto, designated as Exhibit "A" and
made a part hereof as though set forth herein in full.

and through the Director of Highways, hereinafter referr•ed tn as the "STATE" and the
City of Auburn, hereinafter referred to as the "CiTY".
WITNESSETN: `
W4EREAS, the State is planning to construct State Route 167, Auburn: l7th Street
S. W. ta South 285th Street on a new location throv-`i the i.ity ol' Auburrs; aiong with
certain frontage roads and rearranged City streets and
WHERcAS, the said frontage roads, and rearranged City streets wi11 be constructed
in accordance with the ConYract Plans Specifications and detailed drawings therein, .
within the limits af the above referenced revised Right a` Way Pians, it is desirable
ta describe the respansibility of the State and the City in the ma:ntenarce of these
rdadways.
WHEREAS, Subsection 5, Section 11, Chapter 108, Laws df 1907 and RCW 47.52.090(5)
provides that, "The construction and maintenance of City strPets over and under crossings and surface intersections of the limited access facilities shail be in accordance with
the governing policy entered into between the State highway GomFmission and the Associatian
of Washing;Qn Cities". THEREFORE, it is mutualiy aareed that:

The Sta'te agrees to convey to the City by Gove;nor's Deed said frontage roads
and rearranged City streets in accordance with the right of way descriptions as shown
on the aforementioned right of way pians upon compietian of construction and.acceptance
by the City.

completion of construction, in conformance with the contract plans, specifications and
