A RESOLUTION OF THE CITY OF AUBURN ,WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO SIGN, ON BEHALF OF THE CITY, AN AGREEMENT BETWEEN THE CITY OF ALGONA, WASHINGTON, AND THE CITY`OF PACIFIC, WASHINGTON, AND THE CITY OF AUBURN, WASHINGTON, FOR THE PURPOSE OF THE CITY OF AUBURN TO PROVIDE JAIL FACILITIES FOR .THE CITY`OF ALGONA AND PACIFIC'S PRISONERS. THE CITY. COUNCIL OF THE CITY OF AUBURN, WASHINGTON,. DO HEREBY RESOLVE AS FOLLOWS: THAT the Mayor and City Clerk of the City of Auburn, Washington, be and they are hereby authorized and directed to sign, on behalf of the City, an Agree- ment between the City of Algona, Washington, and the City of Pacific, Washington and the City of Auburn, Washington, for the purpose of the City of Auburn to provide jail facilities-for the City of Algona and Pacific's prisoners, a copy of said Agreement is attached hereto, designated as Exhibit "A" and made a part hereof as though set forth herein in full. ATTEST: y Cl e 4-38-73 h i ~ « . j MEMORANDUM OF AGREEMENT THIS IS a memorandum of an agreement between the City of Auburn, a non-charter code city of the-State of Washington, hereinafter referred to as "The City", and the City of Pacific, a municipal corporation under the existing laws of the State of Washington, hereinafter referred to as "Pacific". The City is charged with the responsibility under state law with maintenance of a City Jail. Pacific, from time to time, wishes to commit- City of Pacific prisoners to the City of Auburn Jail. The City agrees to furnish its facilities and personnel for confinement of Pacific prisoners in the same manner and to the same extent as the City furnishes for the confinement of its own prisoners. Pacific agrees to pay to the City for each prisoner the sum of $6.00 towards the cost of booking said prisoner in and out of the City Jail, and the cost of the first day or portion thereof of confinement. Thereafter, Pacific agrees to pay to the City for each subsequent day or portion thereof of con- finement the sum of $6.OO per day for each of the prisoners confined in the City Jail under this agreement. r3illing for prisoners for subs~qu~nt days of con- finement shall be based on the number of prisoners in the Auburn Jail as of 7:00 A.M. daily. The City agrees to bill monthly for all sums described hereunder and Pacific agrees to remit promptly on receipt of such billing. This agreement shall be effective on the lot h day of May 1973, or receipt of a letter from Pacific executed by its authorized official or officials indicating its intent to enter into and abide by this agreement, whichever event occurs later. This agreement will terminate on the 31st day of December , 19'7 4 , and shall automatically renew from year to year until otherwise modified or terminated. This agreement may be terminated by either party, effective no less than 30 days after receipt of written notice given by the party seeking to terminate. This agreement may be modified only after 30 days written notice prior to the ef- fective date of any proposed modification given by the party proposing such modification. PROVIDING, HOWEVER, that the $6.00 per d i em charge here i nabo referred to shall not become effective until January I, 1974. 4-6-73 Page -One ti. t ~ .~ The City of Pacific agrees to maintain a policy of insurance protecting the City of Auburn and its elected and appointed officials and their employees from any liability arising from the rendition of services by the City under this agreement. The policy limits of such insurance shall be at least as great as that provided by the City for similar protection. Pacific agrees to furnish the City written evidence of such insurance. Any duty owned by Pacific by the City under this agreement shall terminate forth with upon termination or failure to renew such insurance protection but such shall not operate to terminate any duty of Pacific. Pacific agrees to abide by and comply with such reasonable rules and regulations as shall from time to time be set forth by the keeper of the jail or his authorized deputies, agents or employees governing delivery to, confinement in, and discharge from the jail. As evidence of the City's intent to enter into the above and abide by this agreement, the signature of the Mayor of the City of Auburn, and the City Clerk, is hereto affixed this 14t h day of May 1973.
