A RESOLUTION OF .THE CITY OF AUBURN, WASHINGTON, AUTHQRIZLNG AND DIRECTING THE
MAYOR AND`.DEPUTY C~ZTY CLERK, TO SIGN, ON BEHALF`OF THE CITY, A CONTRACT
FQR ENGINEERING SERVICES, .WITH HILL, INGMAN, CHASE'AND COMPANY, FOR A
COMPREHENSIVE STUDY OF CITY SANITARY AND STORM SEWER FACILITIES.
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO HEREBY RESOLVE
AS FOLLOWS:
THAT the Mayor and the Deputy City Clerk of the City of Auburn,
Washington, be and they are hereby authorized and directed to sign, on behalf
of the City, a contract for engineering services, with Hi11, Ingman, Chase and
Company, fora comprehensive study and report of City sanitary and storm sewer
facilities, a copy of said contract is attached hereto, designated as Exhibit."A"
and made a part hereof as though set forth herein in full.

CONTRACT FOR Ei1GINEERING SERVICES
CITY OF AUBURN, WASHIPIGTON
THIS CONTRACT, made and entered into this day of
August, 1973, by and between the City of Auburn, -~Tashington,
a municipal corporation, hereinafter referred to as the
"City", and Hill, Ingman, Chase & Co., a corporation in the
State of Washington, hereinafter referred to as the "Engineers",
recites that:
i~lI•iERI;AS, the City desires to make improvements to cer-
tain portions of its existing sanitary sewage collection
systems; and.
WHEREAS, the City has a comprehensive plan dated 1968,
which recommends removal of storm drains from the sanitary
sewage system; and
6:7HEREAS, the City desires to have a stuc:y made of the ex-
fisting storm water inflow and excessive infiltration conditions
in the said sewage collection system; and.
WHEREAS, the City also desires to have a city-wide storm
drainage comprehensive plan prepared; and
WHE:ZEAS, the City desires to retain the services of the
Engineers to perform such infiltration/inflo~•~ studies and
prepare a city-wide comprehensive plan for storm drainage
facilities;
I~Oti°r THEREFORE, IT IS P•1UTUALLY AGREE;) between tine City
and the Engineers that the terms and conditions under which
this ca_.tract will be effective are as follows

The City hereby employs the Engineers to perform all

infiltration/inflow study of the sanitary sewage system
and the preparation of a city-wide comprehensive storm
sewer plan.

The Engineers accept such employment .and agree to per-
form, according to the best of their ability and skill, all
of the engineering services necessary to conplete such a
study and prepare a storm sewer comprehensive plan and to
advise the City in all matters pertaining to the project.
III
The services to be performed by the Engineers for the
inf filtration/inf loca study and the preparation of the storm
sewer plan shall include the .following:
1. Coordinate all work with City officials and attend
meetings with the City for project review.
2. Analyze all available reports, basin plans and
related studies pertaining to existing sanitary
and storm sewer facilities.
3. Assist the City in the preparation of application
forms for State and Federal grant monies that may
be available.
4. A~aY.e field investigatior_s and reccnnaissance sur-
veys of the drainage patterns in the overall
service area.
5. Inventory the location, length, size, age, materials,
~,no~m physical condition and capacity of the sanitary
and storm sewer systems.
6. Develop flaw date from existing records and infor-
mation, for all flows in the sewer system, including
e~Terf lows and bypass flows.
7. Determine location, frequency and cause of over-
flow conditions in the collection system, caused by
infiltration./inflow, based on past observations,
8. Review relationships of existing population and in-
dustrial contribution to flows in the se;aer system.
9. Describe general geographical. and geological condi-
tions which may affect present and future. quantities
or correction costs of the infiltration/inflo~•a.
10. From mair_tenance records and existing data, locate
areas in the sanitary and storn. system that have
inadequate slopes for self cleaning.
Il. identify lines that should be inspected by television
or other means to determine the need for replacement
because of unsuitable conditions.
12. Determine general needs for additional or modified ,
sanitary and storm setrer appurtenances.
13. Develop preliminary estimates for the relative cost
of correcting the infiltration/inflow conditions or
increasing the disposal capacity to provide required
degree of wastewater treatment for the quantities of
infiltration/inflow.
I4. Determine projected sanitary and storm flows for the
City based on anticipated lard use.
I5. P,elate the existing City sanitary and storm drain
system and their service potential to future require-
meats.
1G. Establish preliminary design criteria for sanitary
and storm drain facilities.

17. Study alternative service systems and develop a
sewer and drainage plan with maps shoc~Ting size
and location of the proposed facilities, and their
inter-relation with adjacent areas.
18. Evaluate the existing oxidation ponds for poten-
tial use i. i1 the storm sewer system.
19. Prepare cost estimates, construction schedules, and
priorities to meet existing and future requirements
indicated by land use and projected growth.
20. Prepare an engineering report setting forth the
preceeding information in detail, along with recom-
mendations as to the requirements for construction.
21. .Submit 100 copies of the report to the City.
22. Attend selected meetings with the City, Regulatory
Agencies and other interested groups to review the _
conclusions and reconmendations of the report..

Payment to the Engineers for services set forth in Para-
graph III above shall be an amount equal to Twenty-five
Thousand Dollars ($25,000.00}. The schedule of payments shall
be-made as follows:
1. Monthly upon receipt of the Engineers' invoice
based upon the amount of work performed and
calculated as a percentage of the total fee.
2. The determination of the amount of work com-
pleted and its percentage of the overall project
shall be mutually agreed upon by the Engineers
and the .Director of Public Gvorks of the City.

The Engineers shall complete the studies and sub;:iit 100
copies of the written, bound report and coTprenensive storm
drainage plan within twelve (12} calendar months from the
time of receipt of the formal notice to proceed with the ~:ork.

The report shall be of sufficient scope and detail to satisfy
the Environmental Protection Agency Preliminary Guidelines
for Step ~, In.tilti~ation/Inflow Analysis described in the
Rules and Regulations of the Federal tdater Pollution Control
Act P.mendments of 1972 ,

Since the Client as well as other Governmental agencies
can or may later be able to adversely effect the Engineers'
costs through application of new additional taxes or charges
(for instance, a sales tax on professional services, additional
business and occupation taxes, etc..), amounts due the Engineers
will be increased to compensate for any additional taxation
c:aarges over those currently in effect.

Since the Engineer has no control over the cost of labor,
materials or equipment, or over the Contractor`s methods. of
determining prices, or over competitive bidding or market con-
ditions, his estimates of cost for the project provided for
herein. are to be made on the basis of his experience and quali-
' fications and represent his best judgr~tent as a design profes-
sional familiar with the construction industry, but .the Engineer
cannot and does not guarantee that proposals, bids or the proj-
ect construction cost will not vary from cost estimates prepared
by him.

In the event an invoice remains unpaid for more than 90
days beyond the invoice date, interest shall. be charged from
the invoice date at the rate of 7 1/2 per annum.

The Client, to the extent permitted by law to such mu-
nicpal corporat;.cns , and the *~.gineers , eac'ri b:_r«; tii~m~eivts ,
their partners, successors, executors, adrlinistrators, and
assigns to the other part to this agreement and to the
partner~~, successors, executors, administrators,_and assigns.
of such other party in respect to all covenants to this
agreement.

This contract may be terminated by either part upon
thirty (30) days' written notice, by registered mail, mailed
to the other party at his usual place of business. In the
event this contract is terminated by the Engineers, the Client
will be entitled to reimbursement of costs occasioned by such
termination. In the event the Client terminates this contract,
the Client will pay the Engineers for the work performed, an
.amount equal. to the Engineers' salary costs, times a factor of
2.25 plus out-of-pocket expenses incurred in the direct interests
of the work. times a factor of 1.10.
