HomeMy WebLinkAbout592 RESOLUTION N0. 5 9 2 A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY, A LEASE BETWEEN THE CTTY OF AUBURN AND AUBURN EAST HILL DEVELOPMENT, INC., FOR PARK PURPOSES.' WHEREAS, the City of Auburn and Auburn East Hi11 Development, Inc., desire to enter into a lease for park and recreational purposes; and, WHEREAS, the City Council deems it in the best interest of the City to execute said lease pursuant to the terms and conditions contained therein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON: THAT the Mayor and City Clerk be and they-are hereby authorized and directed to execute, on behalf of the City, a lease between the City of Auburn and Auburn East Hi11 Development, Inc. for park and recreational purposes, a copy of said Lease is attached hereto, designated Exhibit "A" and by this. reference made a part hereof as though set forth herein in full. CITY OF AUBURN. ..r . ~~ ~.-c- MAYOR 9-4-73 LEASE A G R E E M E N T THIS LEASE AGREEN1Ei~TI' made this day of September, 1973, between the AUBURN EAST HILL DEVEL~OPMENI' INC., hereinafter referred to as "LESSOR", and the CITY ~' AUBURN, a non charter code city of the State of WashingtAn, hereinafter referred to as "LESSEE". WITNESSETH Zhat The Lessor does hereby lease try the Lessee the following described real estate situate in the aunty of King, State of Washington: That portion of Northwest 1/4 of Southeast 1/4 lying northerly of line beginn;ng NXN of line concentric with and 330 feet northerly of C/L PSH #5 in Southwest 1/4 of Southeast 1/4 with ELY line of SD Southwest 1/4 of Southeast 1/4 TH N 831.26 feet to TPOB TH N 89-31-21 West to West line of SUBD & terminus less portion PL to Skycrest Terrace less ST, for park and recreation purposes. The term of the Lease will run yearly ecamtiericing from the time this Lease Agreement is executed, at the rental of $1.00 per year, and shall be on a year to year basis. This Lease Agreement may be terminated by either party by giving to the other party notice of intention try ternur~ate of not less than sixty (60) days. Lessee shall also have the right to ingress and egress the above des- criY~ed property along any suitable portion of the surrounding property, also owned by the Lessor, at the mutual agreement of Lessor and Lessee. Lessee hereby agrees to hold harmless and indemnify the Lessor frcan any and all liability of any nature whatsoever occasioned by Lessee's use of the above described real property for park and recreation purposes. At the expiration of term of this Lease, the Lessee will quit and surrender the premises in its present corxiition, ordinary wear and damage by the elements accepted.
