A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,
AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF AUBURN TO EXECUTE A
WATER SERVICE AGREEMENT WITH THE CITY OF PACIFIC, WASHINGTON, FOR A FOUR
INCH WATER SERVICE CONNECTION TO FUNCTION AS AN EMERGENCY WATER SUPPLY.
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING
DULY ASSEMBLED, HEREWITH RESOLVES THAT:
THE Mayor and City Clerk of the City of Auburn, Washington, are herewith
authorized to execute a Water Service Agreement with the City of Pacific,
Washington, for a four inch water service connection to function as an
emergency water supply. A copy of said Agreement is attached hereto, denomi-
nated as Exhibit "A" and made a part hereof as though set forth in full
herein.
THE Mayor is hereby authorized to implement such administrative procedures
as may be necessary to carry out the directions of this legiSlation.

WATER SERVICE AGREEMENT
BETWEEN THE CITY OF AuBuRN AND THE CITY OF PACIFIC, WASHINGTON
THIS AGREEMENT entered into this day of , 1984,
between the CITY OF AUBURN, WASHINGTON, a municipal corporation organized and
existing under the laws of the State of Washington, (hereinafter referred to
as "Auburn), and the CITY OF PACIFIC, WASHINGTON, a municipal corporation
organized and existing under the laws of the State of Washington, (hereinafter
referred to as "Pacific");
W I TNESSETH:
Pacific has applied to Auburn for a four inch (4") water service connec.-
tion to function as an emergency water supply in case of an unforeseen failure
within their own system. Pacific's present water supply is a shallow well
with only one (1) pump presently operable and their storage reservoir is a
100,000 gallon steel tank located at a possible slide area. Auburn and
Pacific now desire to set forth the terms and conditions under which Auburn
will furnish water to Pacific.
NOW, THEREFORE, in consideration of the mutual covenants and agreements
herein, and other good and valuable consideration, the parties hereto agree as
follows, to-wit:
1. Auburn agrees to prov'ide Pacific with an emergency four
inch (4") metered connection to Auburn's system upon
payment of $5,878.98 for the meter. The inter-tie connec-
tion will be made on Ellingson Road near Pacific's well
site.

2. The monthly charge for the emergency connection shall be at
the same rate as established by Ordinance for a four inch
(4") fire line standby charge; In addition all water used
shall be charged at the same rate as Auburn Ordinances
establishes for customers outside the City limits.
3. Pacific agrees that if water is used from Auburn's system
for other than that defined as emergency use, then the
charges for these uses shall be as follows:
PEAK DEMANDS: The rate for water used for peak
demands when no emergency exists shall be five
(5) times Auburn's regular charges established by
Ordinances for customers within the City limits.
REGULAR FULL TIME DEMAND: If Pacific desires water
from Auburn as a continued source'of supply then
the rate charged shall be the same as any commer-
cial customer within the Auburn city l'imits as
provided by Auburn Ordinances.
4. Emergency use shall be defined as water used for a reason-
able period of time not to exceed ten (10) days under the
following circumstances:
(a) Source failure
(b) Reservoir failure
(c) Other failures agreed to by both parties as an
emergency condition.

5. If at any time Pacific requests full time water use of
Auburn's system as a supply source, then Pacific shall be
charged Auburn's "System Development Charge" which has been
established by Ordinance at the rate that is in effect at
the time of the request.
6. This agreement may be cancelled by either party hereto
after the party desiring to cancel gives the other party
thirty (30) days written notice of such cancellation.

Auburn, entitled:
