THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: THE Mayor and City Clerk are herewith authorized to execute a Fire Protection Agreement between the City of Auburn and Fire District No. 31, wherein the City of Auburn shall furnish fire protection services to the areas and citizens contained in Fire District No. 31. A copy of said Agreement is attached hereto, denominated as Exhibit "A" and made a part hereof as though set forth in full herein. THE Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. DATED and SIGNED this 19th day of October, 1987. CITY OF AUBURN ,/,,"'~ '-1. .Q/'//_c ~'".. /' " '. /' .~. ~A~.-)/~~e~.~ MAYOJY,1 ATTEST: 25 &A.)tUwit~ / 26 City Cl erl<" 27 28 29 30 ------------------------- 31 Resolution No. 1783 8/19/87 32 10/8/87 1 FIRE PROTECTION AGREEMENT 2 3 4 THIS AGREEMENT, entered into on the date hereinafter indicated, 5 by and between the CITY OF AUBURN, hereinafter called "AUBURN", and 6 FIRE DISTRICT NO. 31, hereinafter called "FIRE DISTRICT", 7 WIT N E SSE T H: 8 WHEREAS, "AUBURN" and "FIRE DISTRICT" entered into a certain 9 contract called "SALE AGREEMENT AND FIRE PROTECTION CONTRACT", dated March 3, 10 1959, and 11 WHEREAS, because of the lapse of time and changing circumstances 12 the parties hereto have agreed to cancel the old contract and enter into 13 this new contract. That the changes in circumstances include the following: 14 1. The fire fighting equipment transferred to Auburn has lost its 15 separate character and/or has been disposed of by the City of Auburn over the 16 years. 17 2. That the laws of the State of Washington have changed, in- 18 cluding the enactment of R.C.W. 39.34 entitled The Interlocal Cooperation 19 Act, and 20 WHEREAS, the Fire District has no equipment, of any kind, remaining 21 and the said Fire District is cut into small areas, by virtue of most of the 22 District being annexed to Auburn, and 23 24 ________________________ Fire Protection Agreement 25 Page One 5/12/87 26 7/31/87 r 1 WHEREAS, the District, and the citizens therein, have for some years 2 completely relied on Auburn for fire protection, and have no funds by which 3 to purchase the equipment which would be necessary, have no fire station, 4 and have not had the tax base to provide for fire equipment and the 5 necessary station to house the same, and 6 WHEREAS, the City of Auburn is willing to continue to provide fire 7 protection to Fire District, and Fire District desires to have Auburn con- 8 tinue to deliver said services, 9 NOW, THEREFORE, in consideration of the mutual promises herein it 10 is hereby mutually agreed as follows: 11 1. Auburn shall furnish fire protection services to the areas and 12 citizens contained in Fire District No. 31. That such services shall be 13 equal to the services provided to the citizens of Auburn. 14 2. The Fire District shall pay the City of Auburn an amount equal to the annual budget of the City of Auburn Fire Department divided by the 15 16 assessed value of the City, multiplied by the assessed value of the District 17 for any calendar year. 18 2A. In the event that the property tax levy of the District is 19 less than this amount, the Fire District shall levy the maximum property tax 20 rate allowed to the District under the law, and remit to the City an amount 21 equal to 90% of that levy. All payments due to the City of funds derived 22 from the property tax shall be rendered to the City by the District within 23 30 days of the receipt of the property tax distribution to the District from 24 the County Treasurer. 25 26 Fire Protection Agreement Page Two 5/12/87,7/31/87 . . .. ~, " 1 2B. The City shall have the same authority to recover any costs of 2 its fire services within the District as it has within the City. 3 3. That this Agreement shall extended automatically from year to 4 year until either of the parties gives written notice to the other party at 5 least one year prior to the cancellation of said Agreement. 6 4.
