AND HARVEY ROAD AND CONVEYING SAID REAL PROPERTY TO MICHAEL T. REIDY PURSUANT TO KING COUNTY SUPERIOR COURT CAUSE NO. 89-2-19087-7. WHEREAS, the City of Auburn, Washington, has acquired a parcel of land for right-of-way purposes for Street Improvement No. 246 (Harvey Road) pursuant to King County Superior Court Agreed Order No. 89-2-19087-7; and WHEREAS, the City of Auburn has agreed in said Order that Michael T. Reidy be awarded severance damages for an approximately triangular shaped parcel lying west of said acquired property in the amount of $2.00 per square foot, amounting to a net award of $22,556.00; and WHEREAS, the City of Auburn, as an offset to the sums awarded to Michael T. Reidy, has agreed in said Order to transfer to Michael T. Reidy by Warranty Deed the southern half of that roadway to be abandoned known as 14th Street Northeast from the western line of the continuation of "I" Street Northeast at its intersection with 14th Street Northeast to the intersection of 14th Street Northeast with Harvey Road. The City of Auburn will be given credit for that transfer at the rate of $6.50 per square foot for 3,741 square feet for a total credit of $24,316.50; and Resolution No. 2234 August 28, 1W1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, it is in the best interests of the citizens of the City of Auburn to declare the above-referenced property surplus and to authorize the conveyance of said real property from the City of Auburn to Michael T. Reidy. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES: Seotion ~. That portion of 14th Street Northeast, Auburn, Washington, described in the attached copy of said Warranty Deed which is identified in Appendix "B" attached hereto and incorporated herein, is declared surplus and shall be conveyed to Michael T. Reidy by Warranty Deed as stated in King County Superior Court Agreed Order No. 89-2-19087-7 which is identified in Appendix "A" attached hereto and incorporated herein. 8eotion Z. Upon passage of this Resolution, the City Clerk of the City of Auburn shall cause a copy thereof to be recorded in the office of the King County Records and Elections. Seotion 3. Title to the following described real property is hereby awarded to the City of Auburn. (See Exhibit "A" attached hereto 3 and incorporated by reference as if fully set forth). 2. Severance damages to the remainder parcel, approximately 5 triangular in shape to the west of the take, is awarded to Michael 6 T. Reidy in the sum of $2.00 per square foot for the remaining 7 square footage of 11,278 square feet for a net award of $22,556.00. 8 3. Attorney's fees are hereby awarded to Michael T. Reidy 9 in the sum of $5,000.00. 10 4. As an offset to the sums awarded hereto the City of 11 Auburn agrees to transfer to Michael T. Reidy, by warranty deed, 12 the southern half of that roadway to be abandoned known as 14th 13 Street Northeast from the western line of the continuation of "I" 14 Street Northeast at its intersection with 14th Street Northeast to 15 the intersection of 14th Street Northeast with Harvey Road with a 16 width of the half street being approximately 30 feet wide and the 17 total square footage approximating 5,000 square feet. The City of 18 Auburn will be given credit for that transfer at the rate of $6.50 19 per square foot. The city of Auburn will obtain a survey of the 20 section to be deeded to Michael T. Reidy and the price will be 21 adjusted to the extent it exceeds or is less than the 5,000 square 22 foot estimate of the area. The City of Auburn has stated and 23 Michael T. Reidy has relied upon the fact that there are no utilities that would interfere with the development of the portion 25 of 14th Street Northeast to be deeded to Michael T. Reidy. Reidy to relocate those utilities or, alternatively, the City will relocate those utilities 3 at its own expense. 5. The City of Auburn guarantees to Michael T. Reidy a 5 perpetual left-turn movement from Harvey Road into the triangular 6 remainder portion of the property at approximately the present ? location of the 14th Street Northeast intersection with Harvey 8 Road. The City of Auburn further agrees that there is presently 9 the right to make a left turn from the completed "I" Street 10 Northeast roadway into the triangular remainder parcel at 11 approximately the intersection of the present 14th Street Northeast 12 with "I" Street Northeast when completed. This right to make a 13 left turn movement is not guaranteed as to duration. 14 6. The City of Auburn agrees to remove the curb and gutter 15 from the portion of 14th Street Northeast to be deeded to Michael 16 T. Reidy, as part of the present construction project for "I" 17 Street Northeast. The City shall remove the pavement surface as 18 part of the construction work for "I" Street Northeast. 19 7. The City of Auburn has previously tendered into the 20 Registry of the Court $99,000.00 attributable to the parcel leased 21 by Michael T. Reidy and owned by the Riblings. The sums detailed 22 in this Order are in addition to that $99,000.00 figure. 23 8. This agreement between Michael T. Reidy and the City of Auburn is contingent upon the City of Auburn making a fee take of 25 the eastern portion of the leased parcel constituting some 9,184 26 square feet located to the east of "I" Street Northeast. Michael T. Reidy and the City of Auburn 3 stipulate and agree that the value of that parcel is $8.50 per square foot as is the value of the property taken for the alignment 5 of "I" Street Northeast. The establishment of severance damage 6 figures for the triangular remainder portion were agreed to with ? the understanding that the fee take of the eastern remainder parcel 8 would be accomplished at the $8.50 per square foot value. Should 9 the City of Auburn be unable to achieve that fee take for any 10 reason, then the parties agree to reopen their negotiations 11 concerning the severance damages to the triangular remainder parcel 12 and the severance damages to eastern remainder parcel. Should the 13 negotiations be unsuccessful, then the parties agree to submit 14 those issues to trial. 15 9.
