FINDINGS OF FACT
1. The applicant, Henderson Development Inc., through its
agent, Kenneth Kinared, applies for preliminary plat
approval of Lakeland Hills Divisions #9, #10, #12 and
#14.
2. The divisions as proposed would contain 146 lots total.
3. The subject property is 57.3 acres in size and is located
easterly and westerly of the existing Divisions of
Lakeland Hills from approximately 45th to 55th Streets
S.E.
4. The subject property is currently vacant and is zoned R-
2, Single Family. It is designated for single family
uses in the Comprehensive Plan. Surrounding zoning and
land uses in the vicinity include R-2, vacant, to the
north and south; R-1 and R-2, vacant, to the east; and R-
2 and R-4, vacant and single family to the west. Land
located to the north, south, and east is designated for
Single Family Residential uses in the Comprehensive Plan
while single family and some multi-family uses suggested
to the west of the site.
5. The preliminary plat .application is being processed at
the same time as a surface mining permit which would
allow excavation of approximately 125,880 cubic yards of
material and with Division 13 which is processed as a
separate preliminary plat.
6. The large scale development within Auburn known as
Lakeland Hills encompasses approximately 458 acres. As
of this date, there have been seven plats approved which
contain 780 lots. There are four divisions, Division
numbers 5-8, which have received preliminary plat
approval but which have not yet received final plat
approval.
7. The City determined in its review of this project that a
previously issued Environmental Impact Statement dated
October 5, 1981 contained insufficient information to
evaluate the traffic impacts of this proposal.
Accordingly, a new Environmental Checklist was prepared
containing a description of the environmental impacts of

the requested preliminary plat. The City's review of the
environmental checklist resulted in the issuance of a
Mitigated Determination of Non-Significance containing 23
mitigating conditions.
8. The City Council adopted the Lakeland Hills Special
Planning Area Plan as an element of the Comprehensive
Plan on April 8, 1988. The Special Planning Area is
designed to provide a mechanism for detailed planning of
large areas under single or coordinated management.
Therefore, in addition to the guidance as set forth in
the City of Auburn Comprehensive Plan, the Lakeland Hills
Plan Element provides long-term predictability both to
the citizens of the City of Auburn and to the developer
in terms of future planning, zoning, subdivision, and
development decisions.
9. After the adoption of the Lakeland Hills Plan the City
has approved utility plans for sewer, water, and storm
drainage for the entire development of Lakeland Hills.
The plats proposed in this preliminary plat are
consistent with the utility plans already approved.
10. Plans are being completed for the construction of a 5
acre community park to be located adjacent to Division
No. 6 as well as a park next to the Stuck River.
Construction of the 5 acre park is anticipated to
commence this summer while the Riverfront Park will be
constructed in 1993.
11. An arterial which will connect the East Valley Highway to
the uplands of Lakeland Hills, Lakeland Hills Way, is
currently under construction. This arterial will provide
access to Lakeland Hills and will eliminate the current
more limited access currently provided to the area by one
street known as Mill Pond Drive.
12. The Stuck River Bridge has been replaced by a new 4-lane
bridge and the Lakeland Hills developers have deposited
$200,000 with the City for the new development's share of
the cost of the bridge.
13. In order to provide the required access and utilities to
the divisions for which preliminary plat approval is
requested herein, it is anticipated that these divisions
will be developed after Divisions 5-8.

14. To the north of Division No. 9 there is an undeveloped
parcel which does not -have access to a public street.
The Land Division Ordinance requires streets to conform
to the development of adjoining areas.
15. The City of Auburn's Comprehensive Plan seeks to
encourage the retention of vegetation while retaining
areas with slopes in excess of 25~ as open space to
.protect against erosion and land slide hazard. The City
also seeks to develop an efficient collector system for
traffic.
16. The Lakeland Hills Special Planning Area Plan seeks to
provide for considerable park land for Lakeland Hills
residents while creating an efficient street pattern and
improving the existing traffic flow.
17. At the time of the Hearing Examiner public hearing, the
testimony from interested members of the public related
primarily to concerns associated with the impacts of the
surface mining permit. No public objection was expressed
to the preliminary plat application.
18. The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though
set forth in full.
CONCLOSIONS OF LAW
1. The Land Division Ordinance which sets forth a series of
criteria which must be established by the evidence before
a preliminary plat can be approved within the City of
Auburn.
2. The first of these criteria is that adequate provision
has been made for the public health, safety, and general
welfare of the citizens of the City of Auburn. The
preliminary plat as submitted by the applicant and as
supplemented by the recommended conditions both contained
in the staff report and in the MDNS establishes that the
applicant has made adequate provisions.
3. The proposed subdivision conforms to the general purposes
of the Comprehensive Plan in that the Plan designates the
plat for single family residential uses.
Resolution No. 2315
May 26, 1992
Page 4
1 4. The applicant must establish that the proposed
2 subdivision is in compliance with the general purposes of
other applicable policies or plans adopted by the City
3 Council. This criteria is established by the evidence as
the preliminary plat application is consistent with the
4 Lakeland Hills Special Planning Area Element.
5 5. The preliminary plat complies with the general purposes
of the Land Division Ordinance as set forth in Section
6 17.02.030.
6. Finally, the plat meets or exceeds the requirements of
7 the Zoning Ordinance and is consistent with the City's
8 environmental standards.
9 7. The environmental impacts of the proposed subdivision
have been adequately mitigated.
10
11 For each of the above reasons, the recommendation of the
12 Hearing Examiner to the Auburn City Council on the application
13 for a Preliminary Plat is approved and confirmed.
14 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
15 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
16 RESOLVES THAT:
17 Section 1. The above cited Hearing Examiner's Findings
18 and Conclusions are herewith approved and incorporated in this
19 Resolution.
20 Section 2. The Preliminary Plat of applicant, HENDERSON
21 DEVELOPMENT, INC. of a 146 lot single family subdivision
22 located within the development of Lakeland Hills, within the
23 City of Auburn, Washington, on property zoned R-2 (Single

4 Section 3. Such approval also includes the following
5 conditions:
1. Lakeland Hills Way shall be dedicated and
6 constructed from the East Valley Highway ("A" Street
7 S.E.) to the existing Lakeland Hills Way constructed
in Division No. 3 prior to final plat approval.
8 2. At the final plat approval for any division the
9 applicant shall demonstrate that sufficient park
land has been dedicated to the City to satisfy the
10 park needs of this and prior subdivisions as
required by the Lakeland Hills Plan.
11 3. The street names shall be consistent with the
12 existing street name system of Lakeland Hills.
13 4. Each division that is proposed for final plat
approval shall be able to stand on its own and be
14 capable of meeting all applicable City requirements.
15 5. The applicant shall facilitate a meeting between the
City and the property owner of the land to the north
16 of Division #9. The purpose of the meeting is to
determine if access-can be provided through Division
17 #9 to this parcel. The Public Works Director shall
decide if access is to be provided and shall direct
18 the preliminary plat to be revised accordingly.
19 6. The mitigating conditions of the Mitigated
Declaration of Non-Significance (SEP0047-90R) are
20 incorporated herein by reference.
21 Section 4. The Mayor is hereby authorized to implement
22 such administrative procedures as may be necessary to carry
23 out the directives of this legislation.
